    Hi everyone, well I think I am up to the stage to commence court action, I sent my initial letter claiming £628 + interest to which I got there standard 8 weeks response letter I ignored this and wrote to inform them of my intent to commence legal action to which I got a letter referring me back to there previous 8 week letter. Therefore I now presume I commence court action, upon the figure I am claiming do I put the amount including interest that I have asked the bank for or just the amount before interest??

    have sent all the template letters to the halifax,trying to claim back £6785 plus intrest =£8242.54. paid the £250 for the small claims and have just recived a letter saying the halifax are going to defend the claim.now panic is starting yo set in any calming advice would be very much more than appreciated.i have got 28 days from 19 april.

    Not sure if I'm in the right place but I just wondered if anyone had any advice. My parents went OD last week with the Halifax - a cheque was paid out a day earlier than they thought and they had a cheque in their account waiting to clear which it did the following day. They were sent a letter telling them that they were being charged £30 for the privilige. I told them to go and ask them to refund it - which they did but they said they couldn't do it again in the future. A bit annoying as my parents are on benefits and in their 70's. My question is, are the Halifax allowed to charge this amount ?

    I have just come off the phone to the Halifax after being informed from this site that it is illegal for bank charges to be applied if you are on benefits.

    I asked halifax to correct me if i was wrong to which they nicely refunded the £39 on this months statement and last months £39 charge also.
  • after recieving two letters from the halifax saying they are dealing with my complaint and i will hear form them soon,well i have recieveda gesture of good will of 1,943,00 which is great, only the amount i was claiming for was 3,964.00. i would love to hear from anyone who has been offered an amount and declined and still taken it to the small claims court. I am not sure what to do, i will probably be the one who takes it futher and then recieves nothing.

    hi i had an offer of £2048 from the halifax i was claiming £3078 i then phoned them the day the offer arrived and i said that i was not accepting that. i said i would take £3.000 they then said they would settle at £2,700 so i accepted its worth phoning them at that stage and if you have no luck then go through the court. good luck

    Well guys,

    Today is the 23rd and I have filed my application to court online and submitted a request for £914.00 (including interest and court fees)

    It was all very easy to do and I'm now just going to sit back, watch and see what happens really.

    The only contact I've had with Halifax has been via letter so I'm not going to call them as in my last letter I stated that "will proceed to court action without further notice"

    So I will keep the site posted with any updates.

    I have just filed the complaint to the court re Bank cahrges from the Halifax, I have never done anything like this before and feel quite scared about it all I know a lot of you folks out there have done it and won but I still have a niggling dout it could go wrong - please tell me it wont:eek:

    HI There Holley,

    DON'T STRESS , that's what they want you to do! (DON'T BACK OUT NOW) , my wife filed a claim with the Halifax , and got ALL her cash back.

    I know a Halifax employee , who tells me with considerable authority that they allow some claims to go as far as County Court action to try and make people back off or give up, but they havent ever gone to court.

    So far 100% of the time they have settled, so just sit back and relax, next thing you'll get is a legal pack from the court saying you have served them , then shortly after that a letter from Halifax with an offer , if it's less than you asked for refuse and they'll give you the lot.

    Hope this makes you feel a bit better.

    I have sent my letters to Halifax and Lloyds requesting my statements, it is getting close to the 40 day mark, does anyone know the number to call to chase the statements/charges up please?

    hi,

    i sent my first letter to halifax on 14 March, then they replyed with the template letter,
    i sent the second letter which they somehow didn't receive // SO
    i sent the copy of the second letter and the third letter about taking them to court, i got a reply but it said to wait till 15 May .....
    what do i do now can i take them to court cause it's been quite a while
    If electricty comes from electrons, does morality come from morons? :p
