  • hi, im 30 days into the 40 days halifax have to send me the charges i have accured in the last six years, did they respond to you in time, or did you have to send another letter?

    They did response within the 40 day limit for my case. i beleive they'd been in undated with this type of request. Make sure your persistant if they fail to respond to you.

    no carry on claiming its total rubbish just cos your on benefits dont mean you cant claim that would be discriminating. If you go to court process with claim i think it doesnt cost you a penny at court or even massive reduction in costs to claim thru court.

    So if thats the case why do courts allow reductions in court fees for people on benefits???????

    In other words it means you can claim as courts have put measures in for people on benefits

    i would carry on and good luck

    and banks can do what they like they ll still charge you for missed payments etc

    Even if you have to take out the court action they will refund you.
    It is important that at each stage when you give them say 7 days or 14 days you immediately take the action you said you would. I took out my action as soon as the days were up. They came back 2 days later and said they would pay in full, but I was able to say sorry it has already gone to court. This is BETTER because you get the interest as well if it goes to court.
    Martin has laid out all the stages. The only thing you will have to modify is the statement that goes on the summons if you file via the web. It is too big but just abbreviate it, take out the spaces etc. keep the detail and all will be fine.
    If it were me I would not accept the offer and go to the summons. A lady at the Court said they have never fought a case
    Make sure you claim the interest

    I think you have misunderstood the post in that the bank shouldn't take charges from your benefit money, not that they can't claim.

    So if thats the case why do courts allow reductions in court fees for people on benefits???????

    Not everyone who is claiming from courts is claiming bank charges!

    Thanks for the info, as I have always had my Income Support and DLA paid into the bank account, it would seem that the bank would realise I am on benefits.

    My point is that IF it is illegal (perhaps too strong a word, but you get my drift) to take charges from my benefit, they have commited a fraudulant act :eek:
