    Well done on getting the money from Halifax I am just about to file the court papers through Money Claim online just have to scrape the £120 together to set the ball rolling!

    Hi everyone, I'm new to the Halifax thread! Been on the Barclays one doing my own claim but am now doing my friends for her and am wondering at what point Halifax tend to settle. I've just raised the MCOL claim today for a total of £1,457.39 (£1,226 charges + £111.39 interest + £120 court fee).

    Any advice from successful Halifax claimants!?!?

    I sent SAR to Halifax HO on 27 Feb 07, the 40 days would have been up on 10 April.
    Last week I received a letter from them, stating 'the details you requested are' and they'd printed 8 lines of values, showing e.g 2000 07-01 £50 DR
    2002 09-02 £56 DR
    When I total all the amounts up (which doesn't take long!) it comes to £279. A lot less than I thought it would be.
    Has anyone else had this? The SAR letter does request a list of all default charges so is the info the've sent me OK. Should I ask for statements or will they say they've sent me the details I requested?

    Go back to them and say you can't understand their list and can you have copy statements in order to check their list.

    Hi everyone

    Have calculated with interest that Halifax owe me £2247. Have just sent the stage 4 letter threatening to start court proceedings as I am not happy with the "8 weeks to investigate your complaint" nonsense.

    However because I live in Scotland, eveyone knows that you can only claim up to a maximum of £750 in a small claims court and that you can only claim over 5 years.

    My question is can I claim using MCOL for the full amount over 6 years or do I have to go through my local county court which means that I can only claim back 5 years?

    Halifax decided to take £148.00 of charges in 1 DAY followed by £108.00 the next day and £114.00 the day after that!!!!! However those charges were from 6 years ago. If I can only claim for 5 years then I miss claiming these charges back.

    Any advice would be gratefully appreciated.

    Has anyone else noticed that some of the Halifax bank charges are inconsistent? I have charges for £5, £33, £47, £15, £84 etc they seem to have just plucked a figure out of midair rather that setting a standard charge rate. Or am I the only one they have done this to?
    Have been DEBT FREE for 4 years and staying that way :T

    I am new to this and was hoping for some advise. I have 2 issues, the 1st is that I have received my statements for one Halifax account and sent away my letter requesting my charges back. I received a letter back from them saying it could take up to 8 weeks to investigate. I stated in my letter that they had 2 weeks to reply with a settlement figure. What should I do if I haven't heard anything after the 2 weeks and should it be 2 weeks from the date stated on my letter or 2 weeks from when they would have received the letter?

    My second issue is that I requested statements for 2 accounts and only received for one. I have now waited over 70 days and have still not seen the statements for the 2nd account. When I phoned the bank they said it would take another 28 days from the time I phoned. Does anyone know if there is anyway that I can try speeding this up?

    If you don't hear from them in 2 weeks send the letter threatening court proeceedings. I gave them 2 weeks from the date I sent my letter requesting charges back and I got the same '8 weeks to investigate' reply. Have just posted the 'threatening court action' letter today and will give them 2 weeks from tomorrow. As everyone says stick to your timescales not theirs.

    As for waiting 70 days for statements, they are over their 40 day deadline and as you have contacted them regarding this so you could report them to the Information Commissioner for breach of data protection. They should hopefully speed things up for you

  • Hi - Am in the process of claiming back charges from HSBC (letter sent 12/4, acknowledged 19/4), but I have a question:

    I had an old account with the Halifax which I've been closed precisely because of the exorbitant changes applied.

    I have since got a (large!) mortgage with BoS. If I were to claim against the Halifax, would it jeoparidise my mortgage with BoS?

    Any comments/advice would be great. Thanks in advance

    Claiming back your bank charges should not have an effect on your mortgage as it is a separate financial account. You are only claiming charges from your current account not your mortgage account.
    Have been DEBT FREE for 4 years and staying that way :T

    Help, just received a letter stating that I will get a response no later than 18 may, this is in reply to my letter saying they had 14 days to respond to my claim for my charges.

    Trouble is if i go through MCOL what can i claim for, i live in Germany, so it will cost me for flights home, time off work and a b and b, if it gets to court, are any of these things claimable??
