    I wrote to halifax on 12th Feb 07 requesting statements for my credit card and bank account which are both closed.

    I had a letter back for my bank account on the 12th March saying they are dealing with my request and I should receive them within three weeks. I then had a letter for the credit card on the 20th March saying I would get them in the next week. both my cheques had been cashed with in days of them receiving my letters in February.

    So I called both departments to find out what was going on and they now claim they cannot find any details of my accounts. even though I have told them I can still see them on internet banking -but because they are closed I cannot access them online.

    I wrote a letter on 10th April basically complaining about the lack of service and the fact they cashed my cheques acknowleged my letters and now claim they know nothing. I stated in the letter if they did not contact me within 7 days I would go to the financial ombudsman.

    Has anyone any advise what i would write to the financial ombudman and also would anyone know if i can backdate the claim to 12th Feb when i sent first letter because the accounts were closed nearly 4 years ago.

    I'm currently having problems getting 6 years info from the Halifax - I sent the DPA letter off on the 21st March and called to chase them today as I have had no acknowledgement of the request - they say they have not received a letter even though I informed them that I had sent it by recorded delivery and that it had been signed for on the 22nd of March - They have said all they can do is advise me to send the leter again but that would mean starting the 40 day process all over again.

    Could this be a stalling tactic "to lose the request". I know they have a massive backlog at the moment with DPA requests.

    I spoke to their normal customer service and on a number given on this forum - 01422 391 152

    They also said that the address I sent the letter to is incorrect - which I got from this site which is:

    Data Protection Manager
    Trinity Road
    Halifax
    West Yorkshire
    HX1 2BR

    They said the correct address is:

    Data Protection Manager
    Halifax plc
    Trinity Road
    PO Box 548
    Leeds
    LS1 1WU

    Has anyone else sent their DPA to the address given on this forum?

    Hi Pete,
    I am writing about Halifax dragging their feet over the statements you requested, I have been waiting 40+9 day s and had to phone them this morning to chase them up to be told they have a back log and that it could take a further 6-8 weeks longer!
    Have you heard anything recently?

  • Well i rang again today, after a long wait i managed to speak to a young lady who i informed i was ringing to see if we could settle this before i file court procedings on the 24th. She informed me they had 8 weeks from my second letter to respond to me, they were still trying to get through early marchs claims and if i wanted to go to court, no problem at all, she would mark my account for the legal team to deal with.

    Didnt like the sound of that, but i will procede with MCOL on the 24th.

    I'm in the same situation, 40days come and gone, from what i've read on other threads it appears the next stage is to write a letter telling them of your intention of reporting them to the ICO if you dont get statements within 7 days. there is a template letter somewhere on the site to do this

    Have sent both initial letters to the halifax, claiming £2070.00 in bank charges. had no reply so today paid £120.00 to start court proceedings. when reading varies threads with regards to the Halifax its seems the Halifax have settled before it has got to the court stage. Wondered if there is anyone else who has taken Halifax to court and what happened?? Cheers

    Hello,
    This is my first posting.
    I am currently sending off my first letter to Lloyds, however I had a credit card with Halifax (I closed the account a year ago), but I do still have some statements and I can see I was being charged unfair charges quite a lot. Does anyone have any experience of a case like this?

    Is this part true as I have never heard or read this before? Anyone else refused a full offer and gone on to get the interest also?
  • i peeps i need some advice if possible. am claiming dear old halifax and have reached the last stage, they are willing to refund my charges but not the interset. my problem is should i go the full way and actualy take them to court. i got a letter from them today still refusing to pay interest. also the small claims in scotland only goes up to £750 i am claiming almost £2K does anyone know how i should procede. all assistance most welcome

    The bank does not have to pay the interest, this is something that the court adds to your claim. If you decide to continue with your claim you will have to justify to the court why you have turned down the full amount of your claim.

    As you are claiming Scotland you would be well advised to take the money now.
