Ginger2004 wrote: »Just called them. A letter is out tonight for 393! I laughed and said definately not - they argued that I was trying to claim more charges than I had on my acc. According to their system I had 721 and i had 767. They are sending out to me a list of charges that are on their system.
So for the offer
1. £393 - Declined
2. £600 - Declined
3. £700 - Declined
4 £721 - accepted.
They were not prepared to give the interest. I could issue but the interest for me is £150.00 and im not prepared to wait another 6 - 8 weeks for Court issuing and defence being filed.
Any suggestions?
We've got ours back plus interest, I just kept on saying 'no' to their offer and I put a figure to them (which was less but only marginally), they accepted my proposal. We will win this! we will!.... and we did! :j

I received an offer yesterday for 449 of the 752 that the have taken from me in charges, not to mention the 119.66 in interest too.
I called the guy called Neil whose name and number were on my letter and told him that Im not satisfied and am only prepared to settle for 752 - no less.
I have forfeitrted the 119.66 because it equates to about a fiver a charge - as I explained to neil. He spoke to his superrvisor and came back and just said yes - no quibbles.
he was very pleasant about it.
I have asked him to send it in writing to me so that there is proof of the the fact, and I will also be writing to them myself to confirm the telephone conversation
So like I say - stick with it!!!!
Im so so chuffed!!!! :T :T :T :T :T :T

Well I got my offer letter today...My original amount due was £1993, without interest, and the letter offered me £1282..I phoned and said I wasnt happy with this...she asked what was the amount and I told her and she came back with a figure of £1982 so I said I would accpet that..yes I may have been able to get a few more hundred pounds for the interest...But all in all I am actually amazed I got anywhere without going to court...and its almost 2 grand I had written off...
So now its a waiting game to see when it actually appears in my bank.

When i receive the offer letter should i call them back and give them a figure with a bit of interest.
Theyw ere adamant that they would not give me interest even though i know ppl have got the interest back. I said i would issue for the interest but she kept saying well do it then0 -

i would contact local branch and get them to ask head office/customer relations to find out what has happened to your letter and whether its been acknowledged
also send letters recorded delivery then you have proof theyve been delivered and received also try faxing them
i contacted branch when in your position and they were emailed to branch within 5 mins and didnt get charged for list so give that try
try and build a rapport with someone at branch to guide you along the process hope this helps:money:

Ginger2004 wrote: »I started calling on a daily basis near the end of my deadline. Just called and explained i was issuing proceedings and wanted to know how far my claim was she said she had until 8 weeks to respond. I confirmed that I was fully aware of this, but the dates she had given me were incorrect and she was due to give me a response by next fri. I would be issuing proceedings nonetheless today, but would she be in a position to make an offer. She asked me to hold and she came back and said she shouldnt but she would make one today. I have to call back this afternoon.
I think its because my claim is now near the front of the queue to be honest.
When did you send yuor letters in?

in my case halifax sent letter to my previous address.(or they are saying so)jellybean31 wrote: »hi everybody im new 2 all this and hoped u wud b able 2 help me, i have been waitin 3wks for the halifax 2 contact me, after my first letter what is the nxt best step 2 take, any advice gratefully received
u can visit halifax branch and ask them to look into your records and they can confirm(my branch manager confirms so they should to u as well)
u can call up on 08457 25 35 19 dont select 1 they will put u on hold for longer (try to squeez more money through 0845 then they pay out in claim)
send an email to customerrelations@halifax.co.uk(thats the address I was given however I sent a mail today itself so if it doesn't work I will get back to you in next week.
I think you have a slight advantage by not hearing from them
if u speak to them ask why they haven't sent an acknowledgement
Hope this helps

Well everyone I'm on the home straight with my claim against Halifax.
Stage 1- Wrote letter asking for 6 Years Statements.
Response:- Statements within 17days
Stage 2- Totted up charges and asked for money back.
Response:- Sorry you ain't happy, we have 8 weeks
Stage 3- Refund within 14 days or its time for court
Today (19th) got letter saying we are sorry and will response
on or before 21st May
Stage 4- Court.
Now my question is, do I claim interest on top of the charges as well as it seems to give me that option on the court papers.
The amount outstanding on the account/overdrawn amount is (closed since last year) is -£514 and I have requested £798 charges or thereabouts to be refunded which would give me a credit amount of £284.
So do I claim the interest? Or is that asking too much?0 -
when you claim I think put forward for maximum including interest etc.
they will anyway negotiate.
when they never though that xyz amount is too much then why do you bother0
