Halifax are paying me my £310 in interest so i will be getting what i put in my claim for which was £1,544 even without going to court. I wrote to them and supplied info that i was on benefit and in two days they got back to me and said that i can have all my interest for the last 6 years. I wasn't even sure if my letter made any sense but it worked lol.
So I claimed £1,544 with interest and got £1,544 without going to court. Fantastic result. The whole process took me about a month and a half as well.

I told them that i would have been getting interest on my benefit money and they told me to write to their legal team (at the address given in their offer letter) as a separate complaint and see if can get some of my interest credited back to me. Halifax may grant this to me if they feel that they have acted outside of the law.
I will most probably pursue this but i am not 100% sure on that yet.

Ring them up and tell them you are not happy and would like your full money back for xyz reasons. They will up their offer to the amount that you are claiming without interest and go no further.Hi Guys,
Thanks to the excellent resources available on this website i have recently followed the steps to claim back my bank charges from Halifax. With interest the total amount came to £1723.40 of which £1549 is the actual charges and the rest being interest.
I have today recieved an offer from Halifax for £1321.00. I don't really want to accept this as i would like the full amount back.
What can shall i do. I'd like to get back all the amount. Do i reply with letter/phone call saying i expect the full amount back or shall i start the court proceedings.
Any help much appreciated.

Hi guys, first time poster, but have been following this thread for a long time.
I sent the original letter to the Halifax, asking to reclaim my bank charges. I got the 8 week letter response. I then sent the second letter on the 10th, 14 days from the date of the first letter, stating i wasnt happy with the response, and would start court procedings 14 days from this date. I recieved another letter today, dated the 16th saying exactly the same thing, they have 8 weeks.
So, heres the interesting bit, i rang them to basically let them know that i was sticking to my original dates, and would start proceding on the 24th. The very, very snotty woman said they had 8 weeks to comply. I stated that this wasnt a complaint, but a request for my charges back. She started to laugh and said we lawfully charged you. I went through the spiel about common law etc, and got this response ;-
Our charges are lawfull, the office of fair trading has just ruled on this so the charges stand.
I said, no problem i will start court proceding on the 14th, she said, " ok, i will let the legal department know and mark your account with this information" then started to laugh as she put the phone down.
Does this mean there has been a ruling and the bank charge claims are coming to an end, or is it usual customer service rubbish.

Hiya am a 1st time user and its just taken me 20 min to work out how to post this request for help !!
Am trying to reclaim bank charges from the Halifax , its now been 36 days since I sent the 1st letter to them , when I called them today they said it could take upto 10 weeks to get statements out to me !
Is this a stalling tactic ? do they only have 40 days to reply to me ? If so what pressure can I exert on them ?
Answers / things that have worked for you would be greatly appreciated

I have just posted my first letter to Halifax reclaiming charges for £80 plus £0.75 interest.
I have used the initial letter on the website, with a few of my own alterations, firstly making it clear that I am willing to go all the way with this and reducing the time limit from 14 to 7 days. I also stated that they must respond by letter 'should it need to be used as evidence'.
I am wondering that if they do not settle at this stage if it would be sensible to add the cost of sending the letters to them, if three or four are required then I will have lost probably about 2% of what I am trying to reclaim, as I am using recorded deliveries. Effectively, a crime has been committed against me, and without meaning to sound petty I do not think I should have to foot the bill for the letters.
I hear Halifax do not generally settle until the summons is delivered. I hope they know that they are messing with the wrong person now. They have been very rude to me in the past, and got me to open the account under false pretenses in the first place (they promised an interest free overdraft, which has not materialized).
I will keep you updated, and if anybody needs any help with any bank please do not hesitate to contact me, due to my area of expertise I have experience in writing similar letters to local authorities, and have had bank charges refunded in the past without the need to start a court dispute.0 -

I basically got the same response as you....also she stated that it was noted on file... I wasnt put off by this I just sat and waited until MY final demand date came...When it got to the day for filing court proceedings I phoned and asked if they were prepared to settle this before I take this to the next stage.
She was taken aback and asked how I got that particular number
(01244694695--number for claims to be settled) and I wasnt sure where it would go, but its worth a try...Anyhow she said she would sort it out there and then and I am waiting for an offer letter. But I was prepared to start court proceedings that day if I didnt get anywhere.
As we have all said on here they say things just to try and put you off or stall things...In the end WE will be the ones laughing in their faces.

The bank are obliged, under the Data Protection Act, to respond within 40 days. I would suggest that you phone the bank again today to enforce this. If they say it may take 10 weeks, perhaps you could say something along the lines of:
"Under Data Protection and Freedom of Information legislation, you are obliged to provide this information within 40 days. As you have not responded after XX days, I will give you a further seven days to respond before I alert the appropriate authorities".
If you post back with their response I am sure somebody will be able to give you more help.0 -
