But I thought...perhaps I should send them a 3 days warning letter and have them phone me on my mobile to negotiate. I'm only asking for £88. I actually started the process when they notified me of the charges...before they actually took them...which they have done now.
They've missed their own four week progress response - perhaps they did so because of my second letter?
I'm on low income so £88 really really hurts.
I'm wary of going to court as there appears to be a new trend now of the banks applying to the court to have the cases struck...Buying time I suppose.
Any advice or experience?
I today receive their offer of the full amount. It does require both our signatures as its a joint account...I like the part about "goodwill". I just want to be careful before we sign this document. I still want the right to reclaim or cancel any future charges we may incur. We are always on the knife edge.
Will I be waiving my right to future action if I sign this agreement. I mean...in a normal complaint there would be nothing to sign. we would get the money back...as we have previously done several time over the phone and in the branch.0 -
Hey all.
Well I finally had to complete the MCOL and have now filed for £3000 + interest (over 2 accounts). My claim was issued 11/4 and deemed served 16/4!
Now getting a tad nervous as CAG saying shouldn't have put in for interest prior to this stage but I had??!!
Waiting game now then!HBoS = £3700 won!
Capital one = £1500 won!
Studio = £200 won! :beer:0 -
Hi there,
I had an account with Halifax since I was 16. Then in 2005 I was out of work for a few months and some direct debits went unpaid. Because of that I racked up a few hundred quid in charges that I couldn't pay, and after a couple more months the bank simply closed my account.
Can I still claim charges from this account for all the years I had it (if they closed it)?
thanx
sam.

Yes I believe you can claim up to 6 years back from present, even if the account has been closed since.
For example. Its now April 2007. Say your account was closed in August 2004. You can still claim charges that go back from August 2004 to April 20010 -
Thanks, perseverance appears to be the way forward my only fear is that with them saying this is payment in full and final settlement of my complaint, that they may withdraw the offer0

Yup you sure can - for £30 I would just ring them - they'll most likely refund it there and then. By the way, what did you sign?
