  • Hi there. I need some help please. I first wrote to the Halifax on the 25th of Jan. I phoned them on the 20th of Feb to be told they had not received my letter (Which i tracked with royalmail and it was delivered) So the gentleman i spoke to very kindly got me all my statements sent, and it didn't cost me a penny, he did it for free. I looked through six years worth of statements to find that they had took £3829 off me over six years. I worked out that with interest its £4397. I sent the second letter on th 27th of Feb by recorded delivery again. I received a reply stating they have 40 days to deal with my compliant. I sent them a reply telling them they have 14 days to deal with my request and i would be happy to accept £4000 if they deal with it promptly, this was sent on the 3rd of Apr. I have received another letter today stating that they are still investigating my complaint and i will receive a response no later than the 10th of May. What do i do now ? I tried to phone them but got fobbed off by some guy speaking utter jargon. It seems there trained to do this and baffle your head. Has anyone got a suggestion for me please. Many thanks.

Standards letter from the bank, you need to carry on with your next letter or start the court proceedings.
  • Also with regards to the above, do I send my request for details of charges to my branch or to the head office?
  • Thanks for that, cheers

I had similar issues. From what I can gather it's where you live now which dictates which legal system you use.

I've also heard about people in Scotland using the English addresses of friends/relatives in order to take advantage of the English legal system and there seems to be no negative fallout from that.

Your branch should be able to supply details of charges. Also worth just calling the phoneline to ask for them - might get it free that way. ;) And if not you can always write afterwards.

Sorry, forgot to mention that their collections dept. refuse to recognise that I am in dispute with them, insisting that a separate division deals with that and that I should just stump up the full amount of my O/D (near £2k) straight away!

I am going off topic here but the Bank of Scotland pulled the overdraft on my bill payment account and gave me six months to clear it. When I informed them that I was a poor postgraduate and would only be able to pay off half the amount in 6 months they would not accept it. The advice they gave me was not to pay off anything till they called in the debt collectors in 6 months time, absolutley fantastic customer service I am sure you will agree.

Anyhow before I go off topic too much.....

I would say to anyone who gets an OD pulled by the bank suddenley to go straight to the Banking Onbudsman especially if they are not willing to set up a repayment plan that you can stick to. The Bank is within its rights to pull an Overdraft facility at anytime!!!!, but in my opinion they should be a little kinder in allowing folk time to repay the amount, and the more people that complain to the Banking Onbudsman about this behaviour the more likley there will be a change in the Banks policy about suddenley pulling overdrafts.

In my case if I had not asked the bank to reduce the Overdraft limit on my bill payment account then they would never have looked at it.

Send to Customer Relations & recorded delivery x
Hi pink star, a few weeks ack you replied to a few of my posts for me, just wondering how your claim s going as we were at the same stage. Today i have recieved a letter offering me £1407.07 "as a gesture of goodwill". My first letter to them was 8th march for £1868.28 (inc intrest) this was with my own calculation before they sent me the list of charges, sent the court letter dated 23 march for same amount. Next day recieved charges from them(about 6 days over 40 day limit and with me sending letter about info com) From the charges i recieved from them came to £2079.26(inc int). So i called and spoke to the same man i spoke to regarding the statements and he siad send a new letter with the new calculated amount. Sent that 4th april. The letter i got today to make me the offer says that "this amount takes in to account the amount you owed us when we closed your account" . I owe them just over £2000 for an outstanding loan being paid off through iva scheme. They say will send me a cheque £1407.07 within 14days and if i cash it i will accept the offer in full and final settlement. Please anyone with any similar circumstances HELP i don't really know what to do.
SORRY for the long post !!!!

  • Hi Moneysavers,
A quick update , i posted yesterday on here. The banks 8 weeks to respond blah blah was up tomorrow. I received a letter today to say that basicly they're still looking into the matter. They thanked me for my patience and to comply with legislation they have told me I can refer my concerns to the financial Ombudsman. On reading the leaflet that can take from 6-12 months for them to resolve. I have sent them a letter now threatening court action in 14 days . Will keep you informed, Good Luck everyone else ! :money:
