halifax bank charges (merged)

Can anyone help me , I sent letter to halifax requesting copies of statements for the last 6 years they did this after charging me £10 for the service, I then sent another letter listing the bank charges I was owed and asked for a reply within 14 days , i heard nothing. I sent another letter saying that if I did not get my charges back within 14 days I would start court proceedings , I got a letter back saying they would look into my complaint and get back to me within 8 weeks , however it seems like other people have had bank charges repaid a lot sooner than this , do you think I should send another letter ???? :j
You have been entered into their complaints system hence the 8 week delay in answering. They are inundated with these claims and cannot keep up frankly. You dont have to follow this timescale and can apply to the small claims court now. Good luck0 -

Sorry if this has been done before but i am at my wits end.
The Halifax have sent me statments for the last 6 years. However there is not one charge showing on it, and i see i have went over my limit 13 times. I may have got the charge withdrawn once or twice but 13 times!!
Also what is more strange is that they have missed out 2 years worth of statements.
I know for a fact that, that this was the period when i got hit with the most bank charges. After getting in touch with them they have told me that their system has "archived that period" and are unable to retrieve the data for that period.
Anybody else had this problem or know what to do next?
The archived period will be held as microfiche. They certainly can access it. Write advising them that the Information Commissioner has deemed microfiche a relevant filing system for the purposes of providing data in response to a SAR (Subject Access Request) under the Data Protection Act and you are entitled under the act to have that information represented to you in fully comprehensible and legible form on paper.
They are trying it on but this is your comeback. You have grounds for complaint to the Information Commissioner for the deliberate concealment of your data so dont stand for this behaviour.0 -

Hello everyone,
Well, I sent my letter to request my bank charges/bank statements for the passed 6 years along with a £10 cheque by recorded delivery in March. I have not heard anything from them yet but I did say in the letter that I would expect this information in the next 40 days. They still have about 2 weeks to do this.
But my I have checked my online statement and of course they £10 cheque was deducted recently.
I have also just watched Martins video. I am from Northern Ireland and sort of got concerned that he was only mentioning England, Scotland and Wales until the end of the video. Is this the same for NI?
I'll keep you all posted.Barclaycard: £4,217.55/£5 = 0.11% | Tesco £3,810.55/£3,770.55 = 1.05%
Total: £8,027.80/£5 = 100%/0.06%
Mortgage £99,692/£51,652.33 51.8%
Car Loan: £9,217.20/7,527.38 81.67%

Received my statements and am now making my claim!
Do I still send to the same Bank address for Halifax, ie, my branch? Or do I send to a head office?
Any help much appreciated.
Thanks0 -

1. One has an overdraft
2. One claims for back charges
3. Halifax asks for overdrawn monies to be repaid (presumable because of the claim)
4. The overdrawn amount would, in most cases be driven by the charges
5. If Halifax asks for the overdrawn amount be repaid, then one can justify refusing to pay the overdraft back, at this time, as it is subject to dispute.
6. One would assume also that if 1-5 above affects a bank account, so must it be true for credit cards???
COMMENTS PLEASE!
Halifax demanded my overdraft as soon as I put in the claim for the charges!
I have won my claim, am just waiting for it to go into the bank account, on the same day that I received my letter about my claim I also received one saying unless the overdraft was repaid within 7 days further action would be taking against me.
Telephoned them and spoke to a very snotty guy and explained the overdraft would be paid when the other arm of HIS organisation paid the monies into my account. He said he would make a note of that but could not guarantee that further action would not be taken and that I would be able to keep my account.
Told him he could stick his account!0 -

I would take two courses of action at this stage the first being to contact the data commissioner ( think that is what he is called) and report that the bank is in breach of the data protection act. The second would be to phone the banking telephone line (I use 08457 213141) and ask them whatis happening they should have a record of your request for statements and be able to order duplicates at no extra charge (they did this for me on my current and bill payment account). "I'm Just A Demin Boy"
