Hey, haven't posted in a while as I was waiting for Halifax to respond to me, which they have! I served them with a claim on the 27th March, after originally requesting money from them on 12th Feb. The claim was for £1361 + £207 interest, totaling £1568. I've now paid £120 court fees, and since starting my claim, Halifax have hit me with another £112 of charges, even though I have explained that I am in dispute with them, and asked for them to freeze any further charges. They have also started to get heavy handed and asked for repayment of my overdraft in full. They made me an offer on the 3rd April of £674, which I refused, so they then upped it to £1361, the full 6 years worth of charges, but without the interest. I am tempted to take it, just to draw a line under the whole affair and move on. Really, my question is this ; If I refuse their final offer, and go to court, I make it £1688 that the courts would award (£1361 charges + £207 interest + £120 court fees). Given that I have since incurred a further £112 in charges, which I haven't included in the claim, if I settle for their offer, I will be worse off by that amount, plus I will have spent £120 on court fees which I won't get back, effectively making their offer worth just £1129 (hope you're still following, it's confused me!
) They have to enter a defence by the 24th April. What do people reckon, should I take this all the way, seeing as I have come this far? Or take the offer, and get their collections dept. off my back? Cheers!:D Will be offline soon, so pm me or email if you can! Thx again

Sorry, forgot to mention that their collections dept. refuse to recognise that I am in dispute with them, insisting that a separate division deals with that and that I should just stump up the full amount of my O/D (near £2k) straight away!0

I think they have paid you but 'set-off' a sum which THEY say was owing. If the amount was not, in fact, owing, then you are entitled to proceed. However, you should tell them that you are doing this as the Court will expect you to act reasonably and sensibly.0

Hi folks,
Sorry if this has been done before but i am at my wits end.
The Halifax have sent me statments for the last 6 years. However there is not one charge showing on it, and i see i have went over my limit 13 times. I may have got the charge withdrawn once or twice but 13 times!!
Also what is more strange is that they have missed out 2 years worth of statements.
I know for a fact that, that this was the period when i got hit with the most bank charges. After getting in touch with them they have told me that their system has "archived that period" and are unable to retrieve the data for that period.
Anybody else had this problem or know what to do next?0 -
Ring this num 0845 25 35 19 this is customer relations speak to 1 of the managers and inform them if you have not had tour statements within the 40day period you will be informing the information commisioner.xx good luck.
i am also having a bad time with the Halifax
Thanks for the advice.
Called them up this morning and spoke to a lady who once again tried to tell me that their practises have changed and they now send out a list of charges instead of bank statements. She couldnt explain tho how they cashed the cheque despite claiming to have not received it or why they also told me to put just £5 into my account to cover the costs.
She went on to advise that they are currently taking approx 6 weeks to send out statements. I replied that this is good news as they signed for my letter on 9th of march which gives them upto next thursday or so to send them out and if i didnt get them by this date I will be lodging a complaint with the data commissioner. A little taken back by this she said she will email the department involved to try to speed them up.
Hopefully this will have had some effect but i sincerely doubt it as i get a different story each time i speak to them.
Oh well.
Ill keep you all updated as plan to ring on monday to see if they have been sent by then0 -

I am claiming from BOS, I have just filled in a summary clause form available online from the Scottish Courts website, This allows for greater claims than the £750.00 small claims limit up here, I wondered if anyone else has done it this way and if so was it successful, They had their LBA by recorded delivery and signed for 17 days ago yet I have not had any kind of response:)BORN TO RIDE - FORCED TO DRIVE

OK, here are some thoughts I have been pondering over:
Senerio
1. One has an overdraft
2. One claims for back charges
3. Halifax asks for overdrawn monies to be repaid (presumable because of the claim)
4. The overdrawn amount would, in most cases be driven by the charges
5. If Halifax asks for the overdrawn amount be repaid, then one can justify refusing to pay the overdraft back, at this time, as it is subject to dispute.
6. One would assume also that if 1-5 above affects a bank account, so must it be true for credit cards???

OK so I am claiming my charges back - So you send a letter requesting your charges - I try my luck and not send the £10 cheque - Result - list of charges OK not bad going
Partner does the same as she has 2 accounts - One letter back saying will look into your complaint will reply in next 40 days - Hum ok sure my letter stated I want my charges - So sent another snotty letter asking for my charges - another letter back stating the same - Got really snotty sent a 3rd letter - Now settled for my partner and getting back over £350 back though charges where £425 in total - This letter they sent back then included the charges - Partner taking this money - case closed - Again resloved with not paying £10
Partners 2nd account is different - letter received asking for £5 - Not £10 so she can have here charges sent to her - Err but we just got 2 lots of statements free - one complaint settled with no hassle and 1 claim in process and then this - Hello halifax make up your mind please!!!
So can someone explain why there is such a difference in who and the amount halifax want to charge people to receive there charges

Can anyone help me , I sent letter to halifax requesting copies of statements for the last 6 years they did this after charging me £10 for the service, I then sent another letter listing the bank charges I was owed and asked for a reply within 14 days , i heard nothing. I sent another letter saying that if I did not get my charges back within 14 days I would start court proceedings , I got a letter back saying they would look into my complaint and get back to me within 8 weeks , however it seems like other people have had bank charges repaid a lot sooner than this , do you think I should send another letter ???? :j0
