Hi i really need some help.Am having a problem with Bank of scotland requested 6 years worth of statments but have only been sent 2.5 years worth.
I have tried to contact the date protection department several times and did initially recive an answerphone message saying i would have the information by sunday 31st of march as 40 day deadline would then be up.
Have now left 5 mesaages on there helpline number and no reply and no bank statements.Could somebody please advise me of the next course of action to take?

The same thing happened to me - I'm with Halifax. I ended up getting 6 sets of statements from 2004 to now before I finally got the full lot! In the end it took about 3 and a half months to get the statements.
They ended up having to do it a different way - it wasn't statements I got but some sort of account summary printout. I think there was some sort of problem when Halifax & BOS merged.
Anyway, the way I got them in the end was I phoned up their customer relations call centre (on 08456 037960) and spoke to the manager of that call centre. I basically just hassled her every day until they sorted it out.
I'm sure there is a more official way to sort this but this is what worked for me!
Also, when you get the statements and make your claim, I would mention the fact that they missed this 40-day deadline in every correspondence with them. Again, I did this and I seem to have been paid out (over £3k) quicker than a lot of people and they referred to it in the phone call offering to settle.

I have last week just sent letter to halifax threatening them with court.it is past the 7 days i gave them to reply and i havent heard anything.what should I do now.0

It's been a while since I have graced you all with my company, what with one thing and another, although this site has never been far from my mind, thought I would give you the low down on what has been happening with my claim.
Back in December I requested statements from the Halifax, first they told me that they had never received my request, so I hopped along to the bank to get a copy of the cheque that I wrote, and the bank confirmed that it was cashed by the Halifax. Still no statements, although now they admitted they had received the request. With 2 working days left and after I phoned them threatening to inform the information commissioner about their reluctance to give me the statements, I received two letters, the first giving me a complete breakdown of the charges and the second stating that the copy statements would be arriving at my local branch for my collection the following day.
Beginning of Feb I wrote in requesting my charges back and didn't even get a letter of acknowledgement, they claimed that they had acknowledged the complaint but had sent it to a previous address, I made sure that they had my correct details and awaited the next letter. At the end of Feb I received another letter stating they would reply before 8th March, they didn't, so I phoned them, at which point they told me it could take up to 8 weeks. I couldn't afford to put a claim in at that point so I decided to give them the 8 weeks. The day that the 8 weeks were up and I still had not received a reply, so I phoned them again. This time I was informed that they had just dealt with the claim that very day and that a letter was on its way offering me £322 of the £567 that I was claiming. I waited for the letter then phoned the number at the top of the letter and got straight through to the person that sent it. I told her that the amount was an insult as it worked out at just over 55% of what I was asking for, at which point she told me that she would just have a look into the case.
I had decided before the phonecall that I would accept £450 but would prefer £500, when she came back to the phone she increased the offer to £480. I of course bit her hand off and have now received another letter stating it will be in my account within 2 weeks. I have been phoning but so far no money, however when I spoke to customer services they told me that it was taking nearer 3 weeks to get the money to the accounts.
So it was a result for me, despite not taking them to court, but I have found out some interesting information along the way....
Firstly, they will claim that they did not receive your letter, the best way to deliver one I have found is to take it to the local branch and get them to sign for it. I tried 3 times to send one recorded but 3 times it never reached its destination, Royal Mail reckon they are refusing to sign for recorded deliveries now because they are receiving so many requests!!
Secondly, because they have had so many requests they are using the whole 8 weeks to respond, and in fact mine was only looked at on the final day!!
Thirdly, if you speak to them over the phone, I have found that being friendly and polite, but very firm about what you want goes a long way, I was making jokes with many of the staff and it tends to alleviate some of the stress you might be going through.
Also, do be patient, whether you wait the 8 weeks or put a claim in it will take the same amount of time, only difference is if you take them to court you get the interest too.
I was skeptical that I would get my charges back and here I am just waiting for it to be paid into my account, keep battling on and good luck to everyone.

Good News in the end ! ! Could you please inform me of the correct postal address in England for The Halifax to send my first letter to with list of charges owed to me? And do you suggest I take a copy to the branch also?

hi all just wanted to say i phoned for my statments got them after 7 days and 2 phone calls inbetween! sent my 1st letter off 6th april just phoned and its "on record" i intended to phone them every day if need be to get my money back!!!!! they would not wait 8 weeks for their money!!!0

Hey, haven't posted in a while as I was waiting for Halifax to respond to me, which they have! I served them with a claim on the 27th March, after originally requesting money from them on 12th Feb. The claim was for £1361 + £207 interest, totaling £1568. I've now paid £120 court fees, and since starting my claim, Halifax have hit me with another £112 of charges, even though I have explained that I am in dispute with them, and asked for them to freeze any further charges. They have also started to get heavy handed and asked for repayment of my overdraft in full. They made me an offer on the 3rd April of £674, which I refused, so they then upped it to £1361, the full 6 years worth of charges, but without the interest. I am tempted to take it, just to draw a line under the whole affair and move on. Really, my question is this ; If I refuse their final offer, and go to court, I make it £1688 that the courts would award (£1361 charges + £207 interest + £120 court fees). Given that I have since incurred a further £112 in charges, which I haven't included in the claim, if I settle for their offer, I will be worse off by that amount, plus I will have spent £120 on court fees which I won't get back, effectively making their offer worth just £1129 (hope you're still following, it's confused me!
) They have to enter a defence by the 24th April. What do people reckon, should I take this all the way, seeing as I have come this far? Or take the offer, and get their collections dept. off my back? Cheers!:D Will be offline soon, so pm me or email if you can! Thx again
I would push this all the way, the bank will not take it to court, because it opens 2 many flood gates for everyone to sue the bank for unlawful charges, hence why we are all reclaiming the charges, its easier for them to pay back this way than be sued
push it all the way, after reading so many diff stories i think its just ur luck who u get to deal with your case, they have prob been told by the bigwigs upstairs to try n fight it out and save as much as possible, dont give up hope, you will get your money soon0 -

This is my first post so please bear with me if I am asking a ridiculously easy question!
I am just about to start reclaiming the charges that HalifaxBOS have levied on my account (which have caused me no end of problems!) and I am unsure whether the Scottish or English law applies regarding how much I can claim while still remaining within the small claim limits.
I am originally from Glasgow and my branch is still a Glasgow branch of Halifax but I have been living in London for nearly 4 years now and the majority of the charges I have incurred in the last 6 years have been in the last 4 years.
Can anyone advise?

I have successfully claimed back £3k in charges and on the 8th March returned the acceptance forms (there were 2 for 2 seperate acccounts). One for £1400 and other for £1600.
On one of the forms, it said it was paying it direct into an account so I wrote a covering letter stating that as far as I was aware it had been passed over to a debt collecting agency and I was told by them that this account was closed to Halifax. Therefore please send me the amount of £1400 by cheque and ended with I look forward to recieving both cheques.
At the end of last month I phoned up Customer Relations to see where my money was.
After a long phone call on my credit phone where the person couldn't figure out what had exactly happened, they offered me a ring back. I recieved no phone call so topped up my phone and called again at 4.45. Unfortunately for the operator I got the same girl.
They told me they were running days behind with ring backs, I asked to speak to her supervisor and was told she was on leave, I asked for the deputy who convientiently was unavailable.
It transpires that Halifax have posted both acceptance forms on the 'open' account and credited this account with £1600 the amount for the closed account. The £1400 was in limbo and she didn't know what was going on. But she gave me her supervisors name.
I wrote a 2 page letter that evening and faxed it to both customer relations and complainits and told them I wanted a response and/or cheques within 3 days or I will co
Alas no communication from Halifax. The end of last week I sent a letter to FOS.
Can anyone advise what else I can do to get my money?0 -
Received my statements and am now making my claim!
Do I still send to the same Bank address for Halifax, ie, my branch? Or do I send to a head office?

Hi have got as far as 2nd letter, after 1st letter Halifax were treating it as a complaint, 2nd letter as on site, they replied today saying they are sorry I have not had full response they are investigating my complaint at the latest I will hear by May 14th.
Can anyone advise me on where to go from here? Do i wait until May or do I send the letter saying the amount I will accept? Not sure at all what to do, i would really appreciate some advice.
