  • Well I've waited just over five weeks now and have sent the second letter threatening court action. I was just about to go on moneyclaim and do that. But I thought...perhaps I should send them a 3 days warning letter and have them phone me on my mobile to negotiate. I'm only asking for £88. I actually started the process when they notified me of the charges...before they actually took them...which they have done now.

    They've missed their own four week progress response - perhaps they did so because of my second letter?

    I'm on low income so £88 really really hurts.

    I'm wary of going to court as there appears to be a new trend now of the banks applying to the court to have the cases struck...Buying time I suppose.

    Any advice or experience?

    You can go down to your local court and file for free if your on certain benifits .x but first try this tel num 08457 25 35 19 and speak to a customer relations manager.x it is for Halifax isnt it ???

    I requested my statements on 15th February, only just got my current account ones today which totalled to £564 without interest, I never thought it would be that much
    My Card Cash ones came within 2 weeks and that's only £58, but I knew that wouldn't be a lot, with interest it totals to £730.98, I'm gobsmacked:eek:

    I asked for my statements , received them after about two weeks after payng 5 pounds. Sent my first letter off Mse on the 12th Feb. Had a reply on the 16th saying they had 8 weeks to deal blahdy blah. Halifax sent me another letter on the 9th March, apologising that they hadn't yet given me a full response and I will receive a response no later than the 13th April. I have been a patient bunny but now I'm ready to send the third letter on the 13th if I dont hear. There doesnt seem to be any continuity. I know two people who have claimed, got their money within two weeks. I will keep you posted, good luck everyone!

    i experienced the same with the Halifax i have issued the claim via MCOL toady as i have made many telephone calls and there time was up today after i have forwarded all martins letters...i am not prepared to wait thier time limit...it may take the same amount of time as they will file a acknowledgement of my claim ...we shall see i say stick to your time scale.xxgood luck.

    After just over the 40 days (I allowed a couple more due to easter holidays - how nice am I?) I received my charges through the post. However, I was expecting them to be in the form of 5 years worth of bank statements. Not so - the kind people at Halifax have sent me 3 sheets of paper detailing the charges only.

    Presumably I now just enter these charges into the spreadsheet on this site, print it off and send it back asking them to repay them?

    Got a good feeling about this all now, the ball is finally rolling.

    ***Update on my claim so far***

    I send LBA on the 17th of March 2007 - Received a standard reply advising we have 8 wks to reply. I left it 2 weeks then called them on 0142233380 and asked what was hapening and if I was getting my money back. A rather nippy women advised me NO and they would be in touch. I was a little !!!!ed off but I thought ok I will just start the next process now.

    Legal Action - I was a little worried about this and decided to hold off and see what I get, So I decided to give them there 8wks and take it from there. I called them again today on the above number and spoken with a rather helpful man who advised me due to the number of claims there is a backlog, I agreed him with but then advised him that I planned to start legal action unless I get a response. He then advise it was likely I would get a reply within the next 3wks. He also said if I was to start legal action now it would allow HBOS more time than they have left.

    Whats people thoughts? Have I messed up

    Has anyone been contacted by Halifax once proceedings have started? I had got the usual 8 week letter very quickly after sending my second letter. The two week timescale that I gave them was up over the bank holiday weekend so I thought I's call them on Thursday to see what their response was likely to be. I got straight through to some guy who was just towing the company line quoting the FSA regulations...yadda yadda. I then asked him, without going into details obviously, what Halifax's stance on other claims was as it was clear I wasn't the only person claiming. He reeled off a lovely speech about how they have defended themselves rigorously and that all charges are in the t+c's and are perfectly legal. I subitted my claim with court as soon as I put the phone down, but I'm now concerned that they are defending themselves. Has anyone actually lost in court? My claim is for £1771 so it's not a small amount of cash, makes me think they may indeed defend themselves rigorously.

    apparently one person has lost in N.I. to citybank thats it nobody else has lost so far.

    Hi ya all
    Sorry for being a real newbie to this. I have recently followed all of Martin Lewis's instructions and have taken the Halifax to court. The total inlcuding court costs is £820. They have sent me a cheque of £745 saying that as my account was £75 in arrears they have taken this off. My account was in credit of 2.13 when i stopped using it and the Halifax took out two lots of charges taking me £75 overdrawn. SO yes my account was overdrawn when they closed it but that was simply for bank charges.
    I was going to accept this as i just wanted the money.But they sent me a cheque in my name (which as i no longer have an account cant cash) i have tried for two days to sort this. was put on hold on two occaisions for 30 minutes. And when i spoke to customer relations they didnt seem to care.
    So now i have decided i will go all the way and get the full amount in court. I have wrote to them, sent the cheque back but i was just wondering how i now go about starting the court action? I have already paid the court fee on money gov. DO i need to contact them?

    Many thanks if anyone can advise.
