Well as anticipated, the halifaxs attempt to help me claim my charges back have just crashed on its !!!!. Despite never recived my original statement request and having this confirmed by 3 different people, they last week cashed my £10 cheque. called them up to ask how if they never received have they now managed to cash my cheque and what happened to not sending statements and they will inform me of charges? the dense woman i spoke with advised that their policy changes all the time and then adv "if they have cashed your cheque, at least it looks like they are doing something". most unimpressed, I advised that as my cheque was signed for on 9th March, they have only 9 more days to send my statements in accordance with the DPA.
In no way do i expect to receive these and if I dont, whats the next step if they still havent got my statements to me within the 40 day period?

received standard 8 week letter from halifax
sent will file court claim letter due to unsatisfactory response, sent it on 2nd april 2007 giving them 14 days to respond
phoned them today asking if they have received letter which they have! but they have put it aside as they still have 7 weeks now to respond to my claim
do i start court proceedings on 16th april 2007 which is 14 days from the 2nd april 2007 when i initially filed the unsatisfactory response letter????

Dont see why not! Go for it.Stick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.

It's been a while since I have graced you all with my company, what with one thing and another, although this site has never been far from my mind, thought I would give you the low down on what has been happening with my claim.
Back in December I requested statements from the Halifax, first they told me that they had never received my request, so I hopped along to the bank to get a copy of the cheque that I wrote, and the bank confirmed that it was cashed by the Halifax. Still no statements, although now they admitted they had received the request. With 2 working days left and after I phoned them threatening to inform the information commissioner about their reluctance to give me the statements, I received two letters, the first giving me a complete breakdown of the charges and the second stating that the copy statements would be arriving at my local branch for my collection the following day.
Beginning of Feb I wrote in requesting my charges back and didn't even get a letter of acknowledgement, they claimed that they had acknowledged the complaint but had sent it to a previous address, I made sure that they had my correct details and awaited the next letter. At the end of Feb I received another letter stating they would reply before 8th March, they didn't, so I phoned them, at which point they told me it could take up to 8 weeks. I couldn't afford to put a claim in at that point so I decided to give them the 8 weeks. The day that the 8 weeks were up and I still had not received a reply, so I phoned them again. This time I was informed that they had just dealt with the claim that very day and that a letter was on its way offering me £322 of the £567 that I was claiming. I waited for the letter then phoned the number at the top of the letter and got straight through to the person that sent it. I told her that the amount was an insult as it worked out at just over 55% of what I was asking for, at which point she told me that she would just have a look into the case.
I had decided before the phonecall that I would accept £450 but would prefer £500, when she came back to the phone she increased the offer to £480. I of course bit her hand off and have now received another letter stating it will be in my account within 2 weeks. I have been phoning but so far no money, however when I spoke to customer services they told me that it was taking nearer 3 weeks to get the money to the accounts.
So it was a result for me, despite not taking them to court, but I have found out some interesting information along the way....
Firstly, they will claim that they did not receive your letter, the best way to deliver one I have found is to take it to the local branch and get them to sign for it. I tried 3 times to send one recorded but 3 times it never reached its destination, Royal Mail reckon they are refusing to sign for recorded deliveries now because they are receiving so many requests!!
Secondly, because they have had so many requests they are using the whole 8 weeks to respond, and in fact mine was only looked at on the final day!!
Thirdly, if you speak to them over the phone, I have found that being friendly and polite, but very firm about what you want goes a long way, I was making jokes with many of the staff and it tends to alleviate some of the stress you might be going through.
Also, do be patient, whether you wait the 8 weeks or put a claim in it will take the same amount of time, only difference is if you take them to court you get the interest too.
I was skeptical that I would get my charges back and here I am just waiting for it to be paid into my account, keep battling on and good luck to everyone.

I am over the moon...
Today I received a letter from Halifax offering me £644 of the £674 claim I made from them.
This has taken about 5/6 weeks to come through after sending two letters (and also after receiving the bog standard we have 8 weeks to investigate blah blah blah from Halifax only 3 weeks ago!).
Thank you to everyone and this site!
I hope this gives you others thinking about reclaiming a little more encouragement!

This is a good 'un.
I sent a cheque off to the Halifax for £10, to recieve my Bank Statements, on the Current Account that is still open, but Dormant.
This was on 14th March
It is now 11th April, and just by chance, I opened a letter this morning, and lo and behold.. It was a Halifax Bank Statement..they have credited my account by ....yep...£10!
How is it possible to credit my account, with a cheque made out to The Halifax?
(I could understand if my name was Mr Pay Halifax £10)
Would they please credit my account with another one?...preferably a LOT BIGGER next time??:j
Dunno about you guys, but I get the distinct feeling that this is a stalling tactic!
I phoned them to try and get it sorted, but my Security Details no longer match those on their database!?...hmmm
So, not 100% sure where to go from here, but it has made me more determined to screw them over!:rotfl:0 -
