    Hi I have also just received my letter stating it will take 8 weeks so I am just about to send another letter stating that I am not happy and that if I do not have the money in my account in 2 weeks from the second letter I am going through the small claims court JH

    Halifax were quick to send me my statements. I sent the first letter Sat of last week. i have reveived a reply asking me to let them have 8 weeks. I am going to send the 2nd letter do i wait till 14 days after i sent the first letter or because they replied do i send the second letter straight away.

    After being led a merry dance by Halifax (they claimed they didn't recieve our request for statements, despite it being signed for in 29th Feb), we have finally received a list of charges.......BUT.....they aren't ours :eek:

    They have sent us details of someone elses account. No identifying details apart from account roll number, but they definately aren't our charges. The roll number isn't ours and we closed out Halifax account in 2006 and these have charges going up to last month.

    Now what do we do? Obviously I will be ringing them on Tuesday, but this is disgusting.

    Also, is it normal for them to just send a list of charges when we ask for statements? How do we know that what they have put as charges is correct?

    talk to them and let them know the have made a mistake and that you'd like your list of charges.

    I have recieved a letter, like most of you, from the Halifax saying that they will deal with my complaint within the next 4 four weeks, however they say that the FSA gives them 8 weeks.

    OK, I have just been to the FSA website, and it would appear that Halifax are screwing with our minds a bit.

    Yes, the FSA say that a final response must be sent to the complainant within 8 weeks, BUT they also say that:

    DISP 1.4.3 guidance
    1 A firm should aim to resolve complaints at the earliest possible stage.

    OK........how long does it take to regurgitate a cheque from their computers? 8 weeks..4 weeks, I think not!

    Any comments?

    The bank gave me 14 days to expland upon my particulars of claim (that deadline ended 28 March!!:mad: I didn't know about the N224 form until today. :rolleyes: Should I submit it anyway even though I've missed the 14 day notice period? I've already spent £220 going through the courts, so I don't mind paying a further £35! Does anyone know what I should put in it?? The bank has requested my claim be struck out as I faile dto respond to their request:mad: Can't believe I got so far and missed this out. Will the judge show sympathy if I proceed or Iif I do go ahead and lose, will I be liable for all the costs (mine and the bank's?). Please, please, please read your bank's defend and if the offer you in their defence a 14 day notice to provide more particulars, please don't do what I did....you need to complete the N224 form (you cannot claim the 35 quid back). Don't make the same mistake as me...looking forward to ANY advice you've got.

    we all know they are delaying in hope they find a suitable defence. When I got that reply I kindly pointed out the first letter was sent ten weeks earlier to the second so they had plenty of time to investigate. They then said they didnt recieve the first letter so I then told them who signed for it. They are clearly just trying to delay.
  • My story...

    Mines fairly simple.

    Opened a bank account with Halifax about 10-11 years ago after getting a new job, money was pretty basic and managed to keep afloat until the summer of 2001 when i went on holiday and was fast running out of money, so asked for an overdraft, and got £250, that's when the trouble started. For some reason i started struggling to keep up with direct debts and found myself getting charged for it, this happened on and off for the next few years.

    Last year i lost my job due to illness and moved into a new flat and had one charge towards the end of the year, i was brave enough to challenge the charge of £39 as i was only getting £59 a week on benefits, they wiped the charge and told me to be careful in future, then last week i got another £39 charge for a failed direct bebt, they said it will be taken out on the 9th April, but i told them i won't have no money in the bank at that time, to which they said i'll have another charge of £28 on top of that because i'll be going over my overdraft, they were also shirty with me and said they're very strict on charges.

    I'm going to open a new account at Lloyds next week, and confront Halifax about the charge and try to claw back all the other charges from over the years.

    How can they justify the £39 charge? Is their any facts i can tell them to put them in their place?
