    Like most of you I have been told that Halifax need and are allowed 8 weeks to look into my claim on charges. I will be sending the second letter next Sat as this will be 15 days after my first letter which they did respond to so I look forward to their usual negative response. I wonder if anyone has had any succsess with halifax before filing a county cort claim do they not realise that each week they delay could cost them more money through interest charges!!!!

    hi guys, can anyone help? have sent martins letter with the breakdown of charges to hsbc on 6th march, 14 days later recieved a letter saying that they were looking into the charges and telling me that all of their charges are laid out in their terms and conditions blah blah. its now the 8th april and nothing else has come through. don't know which way to go next. has anyone had the same expierience or can anyone advise? all help appreciated.

    Hi,

    You should ignore their letter (they try to fob us all off like that) and continue with Martin's templates regardless. They are just trying to put you off claiming - don't fall for it!

    Get the second letter in the post as soon as possible and good luck (not that you should need luck ;) ).

    Hi,

    1. Yes the calculator is good for credit card charges.

    2. Strictly, you are only entitled to interest if your claim is awarded by the courts and the banks very rarely offer to pay interest unless the claim is at least close to going to court. You can certainly claim for the interest via Moneyclaim without asking for it initially in your letters.

    As for asking for it in your second letter - It is up to you. Personally, I would (I can't see what you could lose by asking).

    I have a question about Halifax and if I can still claim back charges.

    I recently moved house and a couple of direct debits failed to get paid, I rang halifax and as a 'good will gesture' they stopped these charges from being taken from my account. After discussing this with a friend, he pointed me to this web site saying that I could claim back other charges. As halifax have stopped 2 charges from being taken from my account, would this prevent me from claiming other charges? I estimate that my charges have totaled around £1000 over 6 years and I am concerned that they will throw my claim out stating that I accepted £78 refund for the last 2 charges.

    I sent claim 22/2 sent second letter 8th march, they sent full offer on 17/3 so didn't need to file court claim. Fot another one going through which was sent 22/3, only received acknowledgement so far, will let you know.

    Thanks Tozer. Makes sense so i have adjusted the figures. Doesn't make much difference to the total. Was worried though as it didn't match up with the original letters sent to the bank.

    Yes, BB, you CAN claim back charges more than 6 years old. Have a look at other sites dealing with bank reclaim charges and see just how many people are successful with claims back to the early 1990s.

    It's difficult to claim back charges which are ALL over six years old, but the banks pay out on the others. Don't take no for an answer. I have another post around somewhere, describing how you do it. If I ever find it again, I'll post it here.

    And to Tozer - why do you think you can't do it? Do you work for a bank???? (can't do smilies, sorry, you'll have to put up with lots of question marks!)

    Here's the earlier post I made:

    You can claim charges back for six years from the time you found they were unlawful. I suppose you heard about the bank charge/credit card fees furore about the middle of 2006 - in which case you can claim fees back (no matter how old, but be reasonable) anytime you like until summer 2012.

    Your basis for claiming back fees older than six years would be under the Limitation Act 1980, either:

    s.32 (1)(b) of the Limitation Act 1980 on the grounds that you could not reasonably have discovered the bank's deliberate concealment of the facts relevant to your right of action before the report of the OFT was published in April 2006, or alternatively,

    s.32 (1)(c) of the Limitation Act 1980 on the grounds that the payments were conceded on the mistaken presumption that the said charges and interest thereon did not amount to penalties and that you could not reasonably have discovered the said mistakes before the OFT report was published.

    At the time these sums were debited, I assume you were under the mistaken belief that the bank was entitled under English Law to take that money. I'm sure that if you had known that the charges were penalties, you would not have paid those charges.

    In other words, there's no reason to stick to only the last six years.

    The section I've sent you to is for the HSBC Bank only, but there's lots of good stuff about the Limitation Act and you'll see succes stories for older claims. Have a look for your own bank's forum and see how they are playing things.
