As Maniac says, make your DPA request. HSBC will give you your cheque back, so you even get the-rope-to-hang-them-with for free. Again, deep joy!0

I have already paid court fee's tho for my online claim
You have to pay more if claim is above £1500, but you can reclaim these back along with claim
Allocation to track:

You're right about keeping it simple. The way you feel about over 6 years, I feel about contractual interest. I really can't feel comfortable with this - I can cope with charges/overdraft interest, and certainly with statutory interest, but could never argue the case of contractual.
I suppose it really depends how much money is at stake. If your claim is for £3k, and only £200 of that if for over six years, then keep it simple. But if your claim is for £3k and £2k is older than six years, then go for it!
Remember, up to now such cases have never reached a judge - the banks settle out of court.0 -
yes i did all that first time round got an offer back which i rejected by letter telling them they had five days to pay in full or i would be going to court,but that was in feb,
I dont realy want to have to start all over again if i dont need to, bur have paid another 180 pounds in charges since that last letter, so dont now where to go from here0 -

hello heres the story so far. one month ago i sent the bank (to the branch address) by recorded delivery asking for the £1601 in charges they owe me. i did not get a reply after 2 weeks so i sent them another letter, again to the branch by recorded delivery informing them if i didnt get a reply within the next 14 days id take them to the small claims court. i also offered to accept £1250 as a good will gesture. it has now been 16 days and i still have no reply, what step should i take next? legal action online?

send them final letter stating they have 7 days before you take them to court. Tell them if it gets that far you will be going for the full amount plus 8% interest. Good luckStick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.

If you've not got the money then the decree has not been satisfied. Wait until you get the money before acknowledging anything.
You could phone HBOS (or better still write and copy the Sheriff's Court in) asking for a date when fees will be refunded.
Do not acknowledge anything until it has happened and that you are happy (i.e. that the money is in your bank and has cleared).
I know Scottish Law is different from English, but why do you have to perform additional tasks to help HBOS? If they've got a Decree served on them, then they have to action it. Unless there is any legal reason, I would not write to the Sheriff's Court - after all, they [HBOS] could have just refunded you the charges, rather than going through all the hassle!
