  • I closed my HSBC credit card account two years ago, and replaced it with a loan on their advice. However I would like to know if I can apply for the charges to be refunded even though it is now no longer a live account.

    I'm currently trying to claim back bank charges for over £2000 from them too, with no success so far.

    I would definitely not try and claim beyond the 6 year period or else the bank will put in a defence and contest it.

    Very Trying - no I don't work for a bank. I am a lawyer specialising in commercial (mostly contracts) law (admittedly I have done some banking work previously but not related!). The Limitation Act principles you quote are intended to cover latent defects and for personal injury issues where the extent of the injury is not immediately apparent.

    I have never heard of not being aware of a legal principle being an exception to the limitation period. If it was my client, I would be advising not to push it.

    HELP just received a letter off MCOL about the bank acknowlegdment of my claim,says that they intend to defend all of my claim? does that mean i need to go to court then?
  • Hi folks, been lurking here a while but thought i'd join to report my almost success story: I took HBOS to the sheriff court by summary cause(in Scotland) and they didn't enter a plea so I won by default! I got a Decree served and the bank wrote to me advising without admitting liability they have arranged for the full sum owed(£1239.95) to be refunded to my account.

    In the letter they say they will write to the Sheriff court to say the decree hs been satisfied and ask me to do the same, and provide them with a copy of my letter. Thing is, this was a week ago and there hasn't been anything refunded to my account yet. Do I just write anyway to close the case and then they pay? Or do I wait for the cash and then write? Just thought it was taking a while. Anyone had similar experiences?

  • I started to reclaim my bank charges from barclays, they offered me £640 which i rejected back in febuary and gave then the five days or i would take them to court.
    Now the problem is due to ill health and lack of money that five days is long gone, do i have to start at the beginning again or can i still go to court, aslo since then i have been charged another 180 on top of what i was originaly going for so can i add that on my court papers,
    Any help would be greatfully recived

    Wait until the money is in your account before you "close" the case, obviously there will be delays over this week because of the Bank Holidays.

    Ha! That would be so good but I'm not sure about that, still it's taken me six months to get this far, and I promised to get my whole work team a takeaway to celebrate my success if I beat the bank! Regretting that now though...

    So you think I should really just send in the bailiffs?
