I wrote to the halifax asking for a list of charges made on my account over the last six years using the template letters from this web site.
The response said that they would send copies of statements, but "If you requested information relating to manual intervention on your account, I regret HBOS PLC is under no statutory obligation to record this information and therefore, I am unable to assist further with your request."
Is the bank not required by the data Protection Act to provide a simple list of charges made to my account?

there is no set method that the bank have to supply the data to you as long as they supply all personal electronic data about yourself. If they have that on your file electronically they are obliged to supply it I think.

It sounds to me like they are just stalling. If I was you, I'd write back to them requesting copies of all your statements (use the template letter here)

As they say in their letter, they do not have to compile information for you. BUT they ARE obliged to send you copies of what they have.

    I hope this helps.
  • I am in the prosses of reclaiming bank charges from the halifax bank. I sent the list of charges with intrest and stated they had 14 days to reply. They replied in 7 and said:
"we are sorry to learn that you are unhappy with the charges debited to your bank account. please note the complaint handling rules set out by our regulator, the Financial Services Authority, gives us 8 weeks to investigate and respond to complaints. Our commitment to you is that we will respond to your concerns at the earliest possible opportunity. However we want to ensure the issues you raised are throughly investigated. If for any reason, we are unable to respond fully to your concerns within the next four weeks we will write to update you of our progress."

Should i stick to my 14days and send letter 3 threatening court action, or wait for the 8 weeks? please could some one give me sum advice? thanks steve.

All they are saying is they don't record information about manual intervention because they don't have to, so obviously they can't supply you with this data. They have told you they will send you your charge information in the form of statements, so there's no problem.

Please accept my apologies if this has been covered in a previous post but I have two questions:

    1. Can the Bank Charges interest calculator tool be used for a credit card refund claim?

    2. Even though I did not ask for interest charges in my original letters to RBOS, Capital One and HSBC can I add this interest on in a 2nd letter or subsequent claim via Moneyclaim even though I have been made partial offers from RBOS and Cap One or should I have claimed this interest from the start?

Thanks again to everyone who has helped out!
