can you tell me how you submitted your enhanced Particulars of Claim form? I can't find the N224 form anywhere? Do the couurt accept your 3 page document? Don't suppose you fancy sharing some of the stuff you wrote do you? I've missed the deadline and am considering pulling out even though I've already spent £220 to get this far - getting a bit desperate now, so any advice.help you have would be v much appreciated

I'm not sure my PoC would help you because my case was against a certain tour operator as gratitude for their ineptitude in fouling up my holiday plans; it wasn't bank charges related.
Simply use numbered paragraphs and state each point of your claim, making reference to supporting paperwork in your bundle.

Could be halted cos I'm out of time - can't believe I got this far and made such a fatal error! The MCOL mucked up my initial claim - their system somehow removed my claim amount from their form, so I couldn't proceed with my 'notice of issue' (as the bank failed to reply in the 14 deadline) using the online system, so I have to do it via fax - only this takes 5 working days, in which time the bank defended my claim, asking me to remedy my lack of particulars in my claim. I soured this website and many people said 'just ignore it, it's a delaying/scare tactic'. My fault for not checking further. Am I too late to carry on with my claim do you think? Maybe I should consult a solicitor - don't want to go to court and end up losing and paying the bank EVEN MORE money? Did you resubmit the N1 claim for with your revised particulars? I'm such a wally, can't believe I made such a faux pas - feel pretty sick about the whole thing0

Nope, their solicitor tried the usual "Inadequate Particulars Of Claim" gambit and I thought "he wants more detail, he can have it".........just use A4 sheets of well-presented, printed information.....send a copy to their solicitor (as a common courtesy) and one to the Court.You'll always miss 100% of the shots you don't take - Wayne Gretzky

I got my statement through today but only backdated to 2004, I phoned them up and the person i spoke to told me that they have put a note on my account to send the rest through, the other account hasnt even arrived yet! nor has my visa... the weird thing is my mother in law has got part of her statements up to 2004 and has waited for nearly 1month for the rest when she was told they would be posted out.
My other half got his reply through to the 2nd letter saying they now have 8 weeks to look into this....dont worry i will be contacting them in the 40days
what i was wondering is after looking through all the posts what would u advise, that he phone and try to settle the amount or should he wait and put it in writing? i see both ways have been successful

The total amount being claimed is £2754.57 which includes interest. The question I have is if I file a claim for that amount through the court and the bank offer me the amount less the interest before it gets to court is there a chance I will lose the interest, as seems to have been suggested here, and do I have to mention that I want my fees back, or is that taken as read?
If the bank offer you the full amount without interest before you have filed a claim, then you must accept this. You have no entitlement to interest until the court stage. Please read the Step by step article carefully (link in my signature), it describes how Martin suggests using it as a bargaining tool.
If you get to the court stage and you win, costs will be added to the amount claimed.0 -

If you have written the Letter Before Action letter giving them a final 14 days and they have not made a full offer (excluding interest), at the expiry of this deadline, you can file a court claim. The claim would include statutory interest and your costs would also be refunded if you win.0
