I have been successful in claiming money from the Halifax that they unlawfully charged. However, is it possible to claim compensation if because of a charge to my account by a bank, the account goes overdrawn and other agencies who subsequently try and take a direct debit out , and obviously can't, charge me as a result.0

Hello everyone,
Have read this thread and have a couple of queries that I need help with.
I am at the stage of issuing court proceedings (time was up on Tuesday, but kept hoping that the Bank would pay up!). Received the standard letter that everyone else is on about saying they will definitely reply before the end of April.
The total amount being claimed is £2754.57 which includes interest. The question I have is if I file a claim for that amount through the court and the bank offer me the amount less the interest before it gets to court is there a chance I will lose the interest, as seems to have been suggested here, and do I have to mention that I want my fees back, or is that taken as read? I have looked to see if this is covered, but I cannot see a definitive answer. (I was confused by swanseastu's post on 31st Jan).

sent our letter to halifax to asking for the charges giving the the 14 days however had a letter today saying it will take upto 8 weeks as this is what the financial services authority allow them is this ok or do i send a letter stating the have 14 days and 14 days only?:beer: LOVE LIFE PROCEED & PROGRESS0

I agree. Can anyone give us more advice on this. It seems that if you settle early for an offer near the total amount you could be up for a fight. It may be worth going to the next stage. I have with another bank and waiting for an acknowledgement. Will keep you all posted.0

My friend had the same situation. Within a few days of Halifax defending the claim the money was in the account. It just gives them more time to hold out.0

Yes, if you've not signed anything to the contrary. Be aware the bank are more likely to close your account if you make a second claim.0 -

I too had this response from natwest and today got a letter from a solicitor acting for them requesting further info ( see my earlier thread).
Don't worry though we just need to finish what we have started I guess!
I will keep you upto date with progress, hopefully Halifax will settle for you but if not you can follow the advice people are kindly providing me with now!0 -
I have been trying to get my bank charges back from halifax and after sending my letter in and hearing nothing I phoned them last week to see what was going on. Luckily I set up another bank account in the new year as when I rang I was informed my account had been closed!!!!!! They said they hadn't recieved a letter from me asking about my charges, but why close my account then I asked! After many mumbles they said they would send out my charges FREE of charge and I should recieve them within 5/7 days. Low and behold on the 40 th day (today) from whence I sent the orignal letter my list came. I have just worked out that I have got £3831 to claim back without intrest and £4517 with intrest.
I was wondering if anyone had much joy with halifax as I cant see may posts about them. I would be very grateful also if anyone could advise for me to go for with intrest or leave that off my letter??????0 -
Be strong. they are stalling for time..Stick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.
