    can you not call up and threaten legal action unless they pay up soon, i assume you have reached agreement but if they are not paying.....??

    Do you think that when I ring up today, I could tell them that I will be charging them an amount per day for late payment. Any advice.

    I sent a fax on Tue threatening them with court action, I phoned yesterday to see if they had received it and I got took round the houses. So I have just phoned again, (0845 124 1330-press 2 for bank charges) even though I was on hold for 15 mins and yes it was logged onto the system. The lady said its the usual 8 weeks to deal with this and basically I am in a cue along with hundreds of others...as set out by the FSA, I said its up to the courts not FSA, and she said well if thats the route you want to take then its my decission. I asked her if she was prepared to make me an offer, she couldnt right away, can you get back to me later with an offer...eermm no still cant do that. I said I arent happy with their time scale and if they wanted money off me it would be a different story. I said if I dont hear from them by Fri 13th April I will be taking further court action, and she said ok I will log this onto the system.... so lets see if I have stirred things up a little... :j

    I have just rang and have been told by a really nice lady that there is a note on my file saying that its being dealt with, but it could still be a couple more days. She apologised profusely, which kinda messed up my angry speech!!! Although I did find out that they are working this weekend, as there is such a backlog, so I'm gonna ring them again tomorrow!! Will keep you updated. Becky
  • I sent letter 13th March asking for all charges back, then got standard "we have 8 weeks" letter. Resent another letter telling this wasn't satisfactory and I wanted my charges back (around £4,300) but when I rang last week I was told there was nothing they could do to speed up process.

    I rang again just now and was told that 8 weeks was the best they could do so I said I'd probably take the issue to the courts then and they said fine go ahead. So I said I would apply to the courts on Tuesday and they said they have logged this on my account, so looks like I'll have to apply to court.

    Has any one heard quicker than 8 weeks or are they leaving it till the last day? Has anyone got anywhere by phone calls?

    Hi becky, I've just spoke to them and they said that there was a note on my file as well, but saying that it had passed to cashiers after yesterdays conversation. Asked how long it takes from then, she said either today or tomorrow. Told her that today was the deadline and not even open tomorrow, she said that the processing was still being done even though bank holiday. She has said that she will get the team leader to check it and ring me back. Don't know whether they are just fobbing me off knowing that I can't do anything until Tuesday. Will keep you posted.
  • Hi, i have never used this site before but have read some advice that people have given, this urged me to get statments from halifax bank, they only took a week to arrive, so i went threw them all and turns out i only had 5 charges in the last 3 years but with interrest this totals £200, i know it's not much compared to some peoples but as a single parent of 2 small kids this is a lot of money!
    anyway enough about me, i just wondered if anyone could tell me how long to wait before sending letter about court to the bank?
    i sent the first one asking for my charges and interrest back and got a reply today saying; they were sorry to hear about my complaint but they have 8 weeks! to investigate and respond to complaints. but they will be back in touch in 4 to update me.
    can they do this or should i still send the second letter after 14 days of sending the first one?

    can i claim for the extortionate rate the cc charge for money withdraws.

    Halifax still after 40 days giving me the runaround with no statements sent followup letter then told would get them within 10 days still nothing.
    rang on Monday to be told not order yet she would order them and will get them in day or two. Yeah u've guest it nothing, rang this morning to be told they have been ordered (they didn't no why i was told they hadn't beeen order).:mad: :mad: :mad:
    Yesterday rang up Halifax she told me that they were ordered last week 28th March.And that i should once again get them soon.when post eventually came had list of charges but i requested statements so rang up number again there is only one person dealing with charge claim (01422391152) she didn't no that there was another department dealing with it (mind Boggles)these are the ones who suppose to be looking after what money we have in banks,had to give her the phone number of the other Halifax people:eek: :eek: told her i want all statements was told get here next week told her that i'm complaining to ICO.
    it seems the Halifax does not no what they other people in the same company are doing ( well over the 40 days limit it will be by the time i do get statements)

    No you cant. These are not a penalty but a service charge and thus cannot be reclaimed. The bank can charge you whatever it likes to withdraw cash, up to you if you want to pay it.

    any ideas then :mad: :mad: as to what i can do about Halifax I'm going round in circles.One minute they are saying they haven't been ordered then they are saying they have and they don't no why i was told that they haven't been ordered,40 days are well and truly up.I have told them that i'm reporting them to ICO
  • Oh dear - not looking good is it from Halifax
    However on the bright side - i phoned them to get my statements - I was charged £5 for this (not extortionate) but was told it could take up to 21 days to get them (by which time i thought maybe they knew something i didn't - lol) to my great surprise they arrived today after only 6 days (well i was impressed) - i've downloaded the letters and am going to try to claim back around £1,000 (another debt paid if i succeed) will keep you posted :easter_os
