ill let you know how i get on
  • I received £446 from my claim (the full amount) all within a month of the first letter getting received.

I had to send three letters before they paid me the cash.

Coincidently, does anyone know how to reclaim if your account was closed or moved to the creditors/debt collectors???

If you go on to the court website you can fill in form and download instead of waiting for them to send you it lot quicker saving you writing it out http://www.scotcourts.gov.uk/sheriff/summary_cause/docs/summary_form_1a.doc

Thanks again Davit38!!!:A Watch this space!!! And good luck with your claim, remember to keep us updated.
  • OK, so I did everything by the book and sent off for my past charges from Bank of Scotland/ HBOS.

A week past the deadline for sending back the information, and they send me a suspiciously thin package. I open it up and get a letter saying

"We can find no such activity on your account. We include evidence from our system to prove this"

And attached are some screengrabs of their internal system, showing that although I was a customer for over 20 years, there had been no activity whatsoever on my account.

    Everything was marked as "zero".

I did close my account a couple of years ago, however surely they should still have the details of the 4 years worth of activity (and charges amounting to on avarage £100 a month) on archive?

Are HBOS dumping data in order to avoid big payouts?

Can anyone help with my next step?

    Cheers,
    Seaneeboy x

Wev have been issued with an acknowledgement of service by the court, which gives Halifax 28 days from the 28th March to put in a defence. Would it be worth contacting them to see if they will offer on the phone? Is it legal to contact them and ask exactly what their defence is going to be? Finding it so frustrating. It seems as if they are just abusing the court system so they gey longer to pay out:mad:

Ok I just contacted my local court and the lady I spoke to advised me They only deal with claims up to £1500 and I would need a solicitor for anymore?

Is this the case? Really confused just now. Does anyone know of good solicitors that deal with this in the Lanarkshire area?

Now it has got to the court stage, I would say the time for negociation is over. I would let it run it's course and they should pay up soon.

    Hi
I sent off my step 3 letter recorded delivery requesting they pay me back MY 2 grand , and it was delivered on Tue 27th March.
I phoned up customer relations today (Mon 2nd April) to see if they had received/logged my letter. The lady said yes it was on the system and I had been sent out one of their 'standard' 'will take X weeks to investigate my complaint, blahh blahh' I told her thats not good enough and I will be sending you a letter to claim it through the courts.
As soon as I receive that letter (which she said was posted out on the 30th March) I am going to send them the letter as in step 4 I thought once you sent that letter they had 7 days but it says 14 days....
    Well here goes yet again.
