    Hi everyone well I have completed stage 3 of my claim against halifax and sent off my "reply within 14 days or otherwise I'm proceeding with my claim via the courts"

    Three days ago I received the usual "we are sorry you are not happy about what is happening and we will be taking 8 weeks to investigate..." I also received a surprisingly "nice" letter from Wescot saying that they will no longer be pursuing the account was action is halted until Halifax contacted them.

    So now I'm giving it 14 days and without notice will be filing my online court claim.

    Fingers Crossed.

    Hi All

    Just to ask if anyone else has received the following type of letter from the halifax?:
    I've sent 3 letters, 1 asking for statements, 2nd first time asking for charges back, 3rd one again asking for charges back which stated that for a set amount I'd leave there and progress no further to court. I got a standard reply stating that I'd have to wait 8 weeks for the outcome, thats why I sent the 3rd letter to them. I have recevoed the following reply:

    "Further to your letter dated 9th March 2007. I'm Sorry that you have not yet had a full response to your concerns.
    We're still investigating your complaint and will recieve our response asap, but certainly no later then 1st May 2007.
    Our complaints leaflet which we sent you previously, explains how we will handle your complaint."

    I take it now I just get the court papaers issued and hopefully get my charges back?

    Hi Bigmoodog,

    sounds a bit odd to me, the bank helping you ? ? don't think so.....

    Did the cheque get cashed ? ? And if the letter was sent and signed for, you have proof of postage and reciept... So I would sugest that the 40 day rule would apply and if they don't reply with your statements, report them as per your letter...
    Now you could ring up and tell them this, to try and get a satisfactory reply / result. This might get the ball rolling with your statements and hopefully get your charges back...

    Hope this works for you and you get a result...

    cheque was never cashed no, they advised to stop it as, despite it being signed for, they claimed never to have recieved. I just dont want to be the example case where i end up in court and loosing due to bad management of my account. and it was pretty bad. Think ill give them a week or so then call for an update.

    I just completed stage 3 of the process and wrote off threatening court action today (special delivery)

    I expect to get the "We are still looking into your query blah blah blah...." but on the 23 April 2007 (14 working days from tomorrow) I'm proceeding with court action regardless.

    As everyone on this site says Work on your Schedule....not theirs.

    They are obviously inundated with letters and complaints, so they should hire more staff to deal with these complaints :mad:

    I know what your saying but if what I hav heard so far from them is correct, it looks like they just want to get the case closed as quick as they can. Dont get me wrong, I sincerely dont believe this but at the same time im going give the benefit of the doubt and then If im not satisfid, ill press on in the usual way.

    And o course, Ill keep you all updated of mt progress (or lack of)

    Funny reading these posts as I sent to the Halifax on 23rd Feb asking for statement of charges, and had heard nothing last week so followed it up with a phone call to let them know they had about a week left to reply, they said that they never received my original letter and would start the 40 days from the date of my call, i told them I sent the letter recorded delivery and had tracked it and they had received and signed for it on 24th, she then offered to put me through to the "recorded delivery department" !!!!!!....I said no thanks and i hope to receive my statements soon.....I am still waiting and will follow up again on Thursday.

    So it seems their new tactic is to deny all knowledge of receiving letters, even when you have proof of recipt

He said all they would offer was £395 full amount of charges but no interest. This confused me cos the charges only come to £325. So I said send the offer out in writing and then I'll look at it before issuing court claim. This was last Tuesday and I hadn't heard anything by Thursday so I called again and spoke to someone who said a letter should be coming out if that is what I was told but couldn't confirm it and I should wait to the begining of this week. So I've waited still no letter and my 14 days were up a week ago. Do I just push ahead now and file a claim? I think the answer is yes but I'm after reassurance!!
