    It's a delaying tactic and is fairly standard, I would still be confident that you will get your money in full.
  • Hiya, I'm new here, been browsing for a few weeks and decided this is a good time to join!!

    I have decided to reclaim my bank charges for the past 5 years from halifax. Got my statements in (after a 6 week wait and half an hour on the phone chasing it up!!!) and my charges total a massive £6405.00. Sent my first letter off yesterday asking for them back, giving them 14 days to respond.

    I sent this letter to my account holding branch, does anyone know if this is ok or should I have sent it to thier head office? If so should I resend the letter?

    Also I feel slightly overwhelmed by the thought that I will probably have to start the court process and won't be able to put in a small claim. I live in Scotland so the max is £750. Is that right? I've read that you can put in a group of smaller claims, but I would need to put in quite a few. Does anyone know a way around this. Will I need advice from a lawyer?

    Sorry for all the questions, but I don't know where to start and I really want my money back and get revenge on the halifax for all the years they have kicked us when we've been down!!!:mad:
  • Not sure about the small claims court question, but re where to send the initial letter: I sent mine to the local branch which I think seems to make things a bit quicker than sending it to head office or wherever.
  • I too sent the first and second letter to my Dads local branch, they sent 6 years charges within 2 weeks, I sent the second letter asking for repayment with interest (£2662.98) and received a letter 2 days ago,(less than 2 weeks wait) saying they have 8 weeks to sort it out and will let me know within 4 weeks what the situation is. I looked on here and most say the bank is stalling and to carry on regardless, so the letter I sent yesterday is asking for the money back within 2 weeks or I take them to court. I sent that letter to the: Halifax PLC, Customer Relations, P.O. box 548 Leeds LS1 1WU. Perhaps I should have sent that to the local branch but I'm sure it will be okay. Sorry I can't answer about small claims, although there is plenty of help in this forum. Good luck love. X

    :mad: just come off phone to the bank, just to let them know that today is the 7th day since i sent them the step 4 letter, All i got was that the financial authorities have given us up to 8wks and cos' were so busy it is taking right up to 8 weeks. Sent my letter 23 march, do i count the days including the weekends or shall i give them a couple more days before i make my moneyclaim online? any assistance would be very helpful.
    On the other hand i still haven't recieved statements since sending my letter dated 20 feb, told the man this while i was on the phone, he couldn't do enough 4 me then and told me he will get them out to me by monday. Thats good because the claim i meade for £1868.98(inc intrest) was only dating back to april 2004, so they will still owe me more!!!! Just keeping fingers crossed that there isn't anyway they can put a stop to us getting our money back.

    If anyone knows anything at all about claiming the amount I am, please point me in the right direction. I am cluless about this and a little scared!!!

    My husband and i have both managed to get charges back however whilst the halifax were taking their time in paying the money in we have incurred more charges. I sent off another letter requesting them to be paid back but received a snotty letter saying that we had made one claim and that they are entitled to close the account if we incur more charges. has anyone else made a second claim.
