I sent the LBA letter recorded delivery on 19th of March. As yet I have not heard anything back.

Now the 14 days are up on the 5th of April - Thats if I give them 14 working days.

What's people experiences at this stage with HBOS?

Am I likely to get a offer or am I going to have to start court proceedings!

  • Halifax paid up

Claimed via MCOL claim issued 2/3/07, acknowledged 15/3/07
    paid into account 28/3/07

    Amount claimed £2585
    Amount paid £2585

I had no contact from them throughout, no letters,no phonecalls. Only time they responded was when they acknowledged claim 1 day before judgement. I then thought they would defend but 4 working days before end 0f 28days money was in account. I never even got a letter about that either.
Good luck to all you who are still in the process. Mine took since 15th January.

Thankyou all that helped me on this site

    You will win Dale :D

They acknowledged my claim but then didn't defend at all (paying the money in the day after the judgement was issued)

    Good luck!

Yes I have two claims, totalling @ 9,000. Thanks for the advice, I hadn't realised about any exemptions.. I'll go take a look.:D

Well guess what? yes I am exempt BUT only if I do the claim the paper way ie., go to county court and the dates for court hearings are: .... JUNE!

To apply online at MCOL I need to pay upfront and claim them back. Guess the exemptions are there to slap us in the face, yet again.

Halifax are winning, they are knowingly keeping us all waiting til end of April as they know we are broke.
We will win this! we will!.... and we did! :j :p

I am sure you could borrow £240 if you are going to get 9k back, dont give in to the banks

    SUCESSS!

I wrote to the Halifax (template letter) on 28th Feb asking for repayment of charges on two current accounts I have with them.

    1st account £264 in charges
    2nd account £1109 in charges

Recieved letter on 14th day with the 4/8 weeks etc.

Sent next template letter on the 21st March giving them 7 days to respond otherwise i will commence court proceeding

This morning recieved two letters (one for each account) offering:

    1st - £284 (£20 more than requested)!
    2nd - £547 (not good enough)

Gave customer relations a polite call explaining that i wouldn't be willing to accept £547 as a full and final payment and I would continue to file a court claim for the rest. She asked me what i would be willing to accept. I thought £1000 minimum seemed resonable. She said she would have to look over the figures and give me a call back.

    Thought I'd blown it

Within 10 mins someone else called me back saying that the money is not a refund of the charges but a goodwill gesture and £1000 would be a very generous offer. Panicking i didn't know what to say. Luckily she then said would i be willing to accept it?

Yes, i think i will thank you.

They're sending me another letter with details of the new offer and it will be paid into my account in 2 instalments.

Just wanna say thank you to all who are involved with this site. I couldn't have done it with out your help.
