I am sure you could borrow £240 if you are going to get 9k back, dont give in to the banks
Wish it was that simple and just found out it's actually 240.00 for first claim and 120 for second claim, unless I merge but think asking for 9k at one go would be a 'no no'?

Sent my 3rd letter to Halifax by rec. delivery dated 15 March requesting refund of £3816 or will commence court proceedings. Still heard nothing except the standard, 'we'll revert within 8 weeks' letter.
They have just hit me with a further 5 lots of £39.00 in the last couple of days whilst I have been in hospital and just when I don't need it. I just rang them now and asked what they could do to help me about these immediate charges. They 'very kindly' offered to waive 2 lots of £39.00, but said unable to do anything about the other three. My response was fair enough, I've an ongoing claim anyway I'll just add these others onto the total.
My question is, the 14 days was up today, so tomorrow intend to claim via MCOL. Would it be worth me giving Halifax a call with chance to settle or shall I just go straight ahead and claim (for the revised amount of £3933, of course!)?

i sent my cheques off for £10 also to my local branch, i got them returned advising me that they had been sent to the app dept and there was no charge at this time, however i did receive a letter saying there was a £5 charge for this service and i was to call and confirm i was happy to proceed with this0 -
Having sent a letter to the Halifax to reclaim bank charges which amounted to about £2100 including interest, I eventually received a reply on the 22/03/07 offering £837.00 which they said was a goodwill offer and not an admittance of any wrong doing. They went on to say that should they not hear from me within 14 days they would take it that I had excepted their offer. On the 26/03/07 I found that they had paid the money into my account. I intend to push for the full amount but can they take that money back?0

Just wanted to let you know that in the first letter for statements i never mentioned or enclosed the cheque for £10 and received statements within a couple of weeks and no request for charge.
I wrote off for charges with interets and got the standard 4 & 8 weekcomplaint letter.
Tomorrow I will be sending a letter threatening court action. FINGERS CROSSED !!
I also just wanted to mention that I have been writing to my branch address rather than the customer relations and have only used first class stamp on last letter.

Well guess what? yes I am exempt BUT only if I do the claim the paper way ie., go to county court and the dates for court hearings are: .... JUNE!
To apply online at MCOL I need to pay upfront and claim them back. Guess the exemptions are there to slap us in the face, yet again. :mad:
Halifax are winning, they are knowingly keeping us all waiting til end of April as they know we are broke.
Halifax will win if you let them, so get down to the court tomorrow and pick up the forms and take with you the relevant evidence for exemption of court fees. As I understand it you'll find the people there will be very helpful and you can bring the forms home and spend the w/end filling them in and file them on Monday.

There will be conditions to the acceptance of the refund and I would check carefully what they are. Do not sign anything to say you will not claim in future. You can write accepting the refund as partial settlement 'without prejudice' and advise you will continue to reclaim the remainder. They are entitled to withdraw the offer and may well do so if you continue. Dont worry, you will get the lot in the end or at least a better offer. Good luck

I sent the LBA letter recorded delivery on 19th of March. As yet I have not heard anything back.
Now the 14 days are up on the 5th of April - Thats if I give them 14 working days.
What's people experiences at this stage with HBOS?
Am I likely to get a offer or am I going to have to start court proceedings!
I sent the first letter asking for charges back last week they recieved it on wednesday and I have had no response yet. I will wait till friday to send the next one so that they recieve it a week on monday. Then take them to court later that week if nothing has been heard from them.
There does seem to be quite a large range of experience of responses from the Bank I suspect that this is due to where the letters have been sent. It would be handy if people who are in the latter stages of claiming would let us know where they posted the letters to, so we can let others know what is the most effective place to deal with.:beer: "I'm Just A Demin Boy":beer:
