That is fantastic, really put my mind at ease, I thought I would have a long and probably confusing process to go through.
Thanks for that!!!:T
If you go on to the court website you can fill in form and download instead of waiting for them to send you it lot quicker saving you writing it out http://www.scotcourts.gov.uk/sheriff/summary_cause/docs/summary_form_1a.doc0 -
Hi,
I received a letter from my bank that they will deal with my complaint no later than April 30th. This is after sending the 2nd letter giving them XX date before taking the court route.
I spoke to one of their customer relations people and was told that it will be resolved in their own time and before 30th April.
My question is do I just wait until then before filling in the court papers and just go ahead with my own time scale? The bank in question is Halifax bank and the amount claiming (+ interest) is £980
Has anyone had the same experience with Halifax Bank0 -

As has been said many times in the past, it doesn't matter what the banks say because inevitably they will try everything in their power to a) intimidate us or b) bore us into submission by making us wait weeks on end for action.
It is vital that those of us claiming, not only play it by the book in terms of filing the correct letters and claims at the right time but more importantly we stick to our timescale. These are our claims on our terms.
Can you imagine if the bank asked you for a reply to a matter or to pay them monies owed and your response was "I'll deal with it in 8 weeks or I will attend to the matter on such and such a date".
Exactly.
Stick to your timescale because you are in charge here, not them.
For my own case, I have just sent by guaranteed next day delivery (which the Royal Mail's site shows was delivered on Friday 30th), the settle within 14 days or I'll file a claim letter. I thought it was worth a shot rather than going straight to the court claim.
Because I'm a nice person I won't take the Easter bank holiday into account so their 14 days expire on 16th April.0 -
