    No, you have previously made a SAR, this is a case of buying a service off the bank You can't bring a summons for failing to comply with the DPA as they already have. You can hurry things along by adding up all these charges now and sending off a demand for this amount.

    You would be best to go with the information you have. In my ever so humble opinion.
  • Thanks Ropey, So basically I can ask for the charges back without stating exactly what they are for eg bouncing a cheque or an unpaid direct debit?

    When I did my claim for the halifax, I simply listed the dates and the amounts. No further reference was needed, and they paid out without too much hassle.

    Use the info that you have from your statements. That should be more than sufficient.

    This is a standard reply. Just wait for your statements to arrive.

    The bit about Manual Intervention is good from your point of view, as they're basically saying they don't hold records of any. This means they shouldn't be able to use this as a defence.

    my opinion is that statment is incorrect, they say they have no obligation to hold the records but they dont actually say they dont hold the records. My guess is that this information wouldnt be obligated under the information laws to be provided to the customer.

    They are obliged to provide this, if recorded. If you ask and they don't tell you about any, you can assume there is no manual intervention.

    A similar example springs to mind about Abbey recently where they tried to claim records on microfiche didn't form part of the information under the DPA. They went to court, lost and had to disclose the records.

    The point is that if the case did go to court and the defence suddenly produced 'evidence' of manual intervention, the court would take a pretty dim view when you show them that letter.

    Got all of my statements from Halifax, totalled up my charges and have sent them a claim leter for £800-odd (inc interest). They are ignoring it though! Forst off, I wrote to my local branch, is this correct? I couldn't find an alternative one on their site. Also, as I am in Scotland, does this make it harder to take them to court? I looked at Martin's excellent guide, but the details for Scotland seemed a bit sketchy...

    Hi my wife rang 08457 20 30 40 and asked for statments they said ok their will be a charge of £5.00 they will take out of our account. the statments came in about 5 days there was 24 seperate letters so if they can send 24 letters for £5.00 how can they justify one letter for £39.00. have sent letter today to my local branch by recorded delivery and asked for £12973.00 charges to be returned to my account .

    someone was saying on here that they get charged £28.00 and £30.00 is that true because they are charging me £39.00.
