    ...hmmmm...i hope you are not holding your breath on this one...sounds dodgy...they are not a helpful organisation at the best of times and offering to help you get money out of them...this is interesting so i will be awaiting your updates...whilst equally not holding my breath either! Good luck :)

  • Halifax have sent me today an offer and its not even half of what it should be.

    Should i know send them a letter saying i'm going to take court action?

    thanks miz, Well after posting my message i actually got a phone call from the Halifax this afternoon offering me £700 good will gesture of the £1004 i originally asked for, of course i refused saying that i was just typing up my next letter adding the interest. She put me on hold and them came back with another offer of £900 saying that they have incurred cost, again i refused and said that it was'nt good enough. We finally settled on £1000. She is sending me an agreement letter to sign and on receipt of that the money will be in my account in 14 days. What a result i could'nt believe it, things like this never happen to me, I'm over the moon.

    To all of you who are feeling bogged down by the halifax please please dont give up it will happen for you all just keep trying.

    Thanks to Martin for this fantastic website without you i would not have dared to challenge tha bank.

  • I got a letter back from HBOSplc in Halifax. I sent to my branch in Newcastle originally.

    It said that duplicate statements will be sent - with technical explanations (eh?) within the next 21 working days.

    The puzzling bit - 'if you requested info relating to manual intervention on your account, I regret HBOSplc is under no statutory obligation to record this info and therefore, I am unable to assist further with your request'

    Can anyone put that into plain English, please?

    yeah, im not holding my breath on this one. Its had me puzzled all evening as iv read most of the halifax posts on here and it doesnt seem to have been mentioned before. Im hoping beyond all hope that they have given in and are closing these claims as quick as they can and this is the new procedure. i know it aint likely tho.
  • Does anyone know what the procedure is for claiming more the £750 should my claim for charges go to court. I have no problem going to court but I am claiming £2011.47 including interest. I have had a look online but can't find any advice on who to contact and what claim I need to submit to the court.
    The links on Martin's site take me to the scottish claims but they only detail the procedure for a small claim, less than £750.
    Any advise on who to contact regarding court procedures for larger claims in Scotland would be much appreciated.

    My senario is I sent my first letter on 20th Feb to which i had the usual reply stating 8 weeks to deal with request. I received a second letter today stating that they are still investigating my claim but would have a response for me no later than 25th April '07.

    I am considering waiting till 25th but as stated above should I need to start court proceedings I don't know who or how to claim these larger sums.

    Basically you have two choices, either:

    1) Split it into 3 x £750 separate claims, OR
    2) Contact the Financial Ombudsman and let them take up the case on your behalf. The latter will be slower though, and you are less likely to get all of the money back, which you are entitled to.

    Hi Helen, I'm being told 28th April also, I'm now wondering if this is yet another tactic? why the hell can't Halifax just pay up what they owe? I've said it before, it the shoe were on the other foot, we wouldn't stand a chance in 'delaying'! :mad:

  • Took me a year to get around to claiming my bank charges from the Halifax, as soon as I sent my letter off giving them 2 weeks to reply, somehow managed to get overdrawn twice incurring charges of £88 can I reclaim these charges even though my letter is winging its way as I type?
