    i got a phone call saying my charges are only £650,i am claiming £1444.
    when i explained to the man that i have checked all mine he asked if i could send all my statements to him,i said no sorry i aint copying all them u must have a copy it was u lot that sent them to me.i read my list of charges out to him he said his team would investigate and get back to me,i was at work tonight when my partner phoned me to say the bank have phoned and offered u all your charges plus court fees back he is going to send u a letter out. 1 he should not have discussed this with my partner as the account is in my name only.and im thinking of pushing them for the interest too any advice welcome.

  • Please can somebody tell me if Halifax will charge me for requesting a statement of charges. I am just plucking up the courage to start this ball rolling and would really like some feedback to calm my nerves!!!!

  • Hi, just to say thank you Martin for all your advice on reclaiming back charges. I sent out the first letter to my bank, Halifax, i had a reply within 2 days saying that they were looking into it. Then after 13 days i had another reply offering, 'as a token gesture' my charges + interest repaid back into my account within 14 WORKING days. On the 14th day the money was in my account. My charges were just over £500 including interest, a drop in the ocean to them, but to me it means i can take my kids on holiday this year (im a single parent). My charges were only incurred over about a year when i was ill & on the verge of a breakdown, i had £120 charges in just 1 month, EXTORTION!!! Thank you so much. :beer: :T

    Have had 1st letter from Halifax saying they have so many weeks to reply. Am just copying Martin's LBA, but do not know which court I would be applying to (Hoping it won't get that far). Can't look on Consumer Action Group as I am with AOL & thaey seem to block everything. Where can I find out???

    It is supposed to be 40 days max ,with us we still didnt get them until a few days after this, and that was after a phonecall to remind them.Thats with the halifax they seem to like dragging it out;)

    My advice at this stage would be to take the money and run at this stage.

    When the bank sends out the settlement letter they will have a clause in it saying that you agree to hault any further proceedings. You could turn back to them and say that you are not going to accept this and want statutory interest added, but this is quite a risky strategy, as the bank are within in their rights to offer a reduced settlement, if you throw this one back at them.

    Offered :- £648
    Accepted :- £1400

    Bill Payment Account claimed :- £3800 plus interest
    Offered :- £1900
    Accepted :- £3000

    However.... nicky1312 has filed at court and is now due his court fees and the interest to be included in the offer as the bank would have to pay this if it goes on to court.
