Hi all after lurking around the board for several weeks now I decided to bite the bullet as it were!
Received 6 years worth of statements on 28/02/2007
Sent request for refund letter on 01/03/2007
Received a standard we have 8 weeks etc reply on 14/03/2007
Sent final request for refund 16/03/2007.
Am claiming £1166.00 in total over two accounts.
Would appreciate if anyone could advise me, does this need to done in two seperate court claims or can it be done in one?

The story so far!
I have two bank accounts with the Halifax.
1 in my name the other a joint account with my bloke.
A combined total of £1373 in charges. plus £268.78 interest
I have all statements since opening the accounts and sent the first letter 28/2/07 requesting repayment of charges.(1 letter for both accounts)
Got 2 seperate letters (1 for each account) with the standard 8 weeks response, but intend to continue with my timescale and send the next letter.
Is it ok to claim for two accounts in 1 letter?
I live in Sheffield but intent to use the online moneyclaim form, (depening on banks response)
What do I write in the "Insert name of court" bit of template letter?
(Sorry if this is obvious)

HiI requested statements from Halifax over 4 weeks ago and chased them twice and was told they are on the way but to no avail.
How do I get them? They ahve the 10 fee as it was recorded and they have told us it was received? What do I do? Any advice please?

Edinburghlass thank you for your reply. I'm getting a little confused after your advice as Martin's step by step guide contains this sentence when talking about the 14 day notice letter to file a claim.
"Some people skip this step, but it’s often worth a shot, as if it works it saves actually having to start the court process. "
The BBC's Money Programme guide doesn't mention that step and advises going straight from the 14 day letter claiming charges to filing a claim.
My other problem is that despite the fact that today is the 15th day since I sent my request to the Halifax I cannot be sure when the letter was signed for at the bank as the Royal Mail's track & trace function at their website can't give me the info. I've asked customer services to look into it.
I don't want to give them anything that could jeopardise my claim so if I can't get an answer from the Royal Mail I may well have to give them 14 days from the date of their "8 weeks" letter to be sure.
I'm still thinking of giving them a call anyway to see if I can get a helpful assistant who will give me a settlement over the phone.0 -
Hello.
I've finally put pen to paper and asked those robbing niffers over at the Halifax to refund my charges as per MSEs advice.
I phoned them up, as, after 50 days, they hadn't responded with my statements. They said that they didn't recieve my letter, so I sent the second letter giving them 10 days in which to send my statements or I shall take the matter further. Low and behold I recieved a letter the next day saying that my statements were in the post.
Work that one out.
Anyway, after a quick scan through all the charges, and including interest, good old Howard Brown and his cronies, owe me about 5 grand !
So, next letter goes to the Halifax tomorrow :T
Most of the charges are because they closed my local branch and I have to travel 20 miles to Cambridge to pay in my wages as my business acocount is with Barclays - normally this is impossible to do on the right day because of kids etc. I have recieved up to about 300 quid in one month of bank charges. If they close my account - good. All the better for me as I shall continue to bank with Barclays.

Just got wind of this over here in the USA. I am now a non resident of the U.K, been living in U.S for 4 years, still have a Halifax account...and it's still in overdraft! Is there any special circumstances or facts I have to take into consideration before starting out on claiming unfair bank charges, being in the U.S and all?
In 2000/2001/2002 I lived in both Scotland and England and transfered authority of account to branches in each city I lived in...if I go ahead, where would I file court proceedings?
Thank you for any help you can offer. This does sound like exciting stuff...

I am in the process of chasing Halifax bank for charges and have just sent of my first letter requesting details
I've agreed to do the same for a friend with charges with MBNA. She's has trouble with them in that they do everything by telephone and not in writing, leading to some heated discussions with them.
A question; how correct is that for them to act on phone calls only??

Ist time using this so here goes:
Requested statements from Halifax on 1.02.2007 and on 38th day received a letter saying being sent under different cover, on 40th day(10.03.2007) called them to asked why they had cashed my £10 cheque on 14.02.2007 and still not got info together. She told me if I had not got them within 2 weeks to call back,I told her they were just stalling, 2 days later received staements.
Sent claim off for £3121 plus £393.36(interest) on 19.03.2007 and awaiting response but from reading this site think I will get the 8 more weeks letter!!!!!
