So what are you going to do ?????
My deadline to them was today, I've been onto them via telephone. I've been told they are inundated with charge refund appliations and therefore we are ALL being told to wait up to 8 weeks. I've told her not a chance. I'm off to fill in court papers now. My only trouble is... here the hell do I find the 250.00 to start the complaint off in the first place? Damn the banks :mad:We will win this! we will!.... and we did! :j0 -

I just got a phone call from Halifax Customer Service. They have just agreed to pay out £3,205. I was claiming £3,275. Not going to quibble about £70 - think I might have actually miscounted anyway ;0)
The thing is, when they guy phoned up at first he started talking about the OFT and credit card charge "ruling" and how they were going to come up with a figure of "£12 or a bit higher" as legitimate for bank charges.
I then got:
"Because of this we're obviously not going to give you the full amount. We could just sit tight and wait for the OFT but we want to get this settled now so lets see if we can come up with a compromise. How much would you be prepared to accept?"
I said I'd accept the full amount please otherwise they'd be liable for interest and for court costs when I took them to court, which I would be doing straight away.
He went off to "speak to his manager" for like 30 seconds and then came back and agreed to pay me the full amount.
So don't let them pressure you over the phone into taking less!
Can I ask.. how long did this process take you from start to finish? Did you have to go down the court claim route to get a result? We will win this! we will!.... and we did! :j0 -
they always say that and then settle the day before from what i understand.... so dont worry..0

It took an amazing amount of time to get the statements in the first place. I sent my first request in November. They kept sending me half the statements (I have 5 sets of 2004-date!) but wouldn't send me the older ones.
At that time I hadn't come across this site so I wasn't probably pushing as hard as I should have. Eventually I got the statements at the end of February.
The timeline since then was:
3rd March - sent first letter, asking for charges to be paid back. Also faxed a copy to Elaine Shaw - Manager of one of the call centres. She phoned back the same day giving it the "we have 8 weeks to respond" rubbish.
13th March - phoned Halifax to discuss. Not sure I'd advise doing this - just got the same "8 weeks" response, but you never know - it might have had some effect.
20th March - received no written response from Halifax at all so sent 2nd letter: "14 days to pay or I'll take you to court".
Today - I got the phone call, eventually offering a full refund. I don't know if they even received my second letter yet as it hasn't come up on Royal Mail's tracking site yet.
That's basically how it worked for me. The guy today mentioned the fact that it had taken so long to respond to my statement requests so it might have been that that brought things forward...
Happily, I didn't have to actually go down the court route or serve papers or anything!
Hope that helps,

Thanks Mon... my timeline has been similar:
28th Feb - first letter recorded delivery
3rd March - letter from Halifax stating 8 weeks blah blah
9th March - I decided to ignore their 8 week blether and sent 14 day letter (to offer a repayment or within 7 days court action)
14th March - Telephone Customer Svcs - told to ring back on 21st
21st March - Rang back told me their 14 day deadline was 28th March (just to write to me) and 28th April for full and proper completion of claim.
I now have to either wait until 28th March for a measily letter or 28th April for an offer or court action. I'm loathed to fork out 250.00, I simply cannot afford this... guess they are starting to get the better of us after all.
Feeling very low today. We will win this! we will!.... and we did! :j0
