  • hi there i'm new to all this hope im in the right place. im hoping there is someone who can help me out on what to do next regarding the correspondance i have recieved from halifax.
    first of all i wrote to them about 3 and half weeks ago requesting copy of charges, recieved letter saying as goodwill gesture they won't charge me the fee of £5 to do so. still haven't heard anything back from that. so got together statements i have back to 2004 and calculated the charges to be £1898 with the intrest. so got on to them with the first template letter posted 9 days ago and got reply today statig"sorry to hear that you unhppy with the charges on my account, please note the handling rules set by the regulator, the financial services authority, gives us 8 weeks to respond to complaints". they go on to say that it will be investigated and if they are unable to respond fully to my concerns within the next 4 weeks they will write to update me of the progress. anyhow what i am wondering is will i beable to make another claim to them when they do eventually send me the statements i need for the earlier years? and what about if i have an un paid loan to them? has anyone recieved anything already owing the bank a loan? also does anyone think i should reply to the leter i got today or hang on for them to contact me again?

    My first post here and can I just, firstly, say a very big thank you to those who have given up their own time to offer advice and information on this issue.

    My dilemma (or should I say my fathers dilemma is thus) - his charges over 6 years just exceed £5000 and, unfortunately, this figure falls outside what can be claimed in the small claims court. He has written to the Halifax and asked for his charges to be refunded within 14 days but it is unlikely that they will refund him his full charges within this time.

    It is more probable that he will receive one of these '8 weeks to respond' letters - would it be advisable for him to seek a private solicitor now and, if so, will he have to pay his own legal fees whether he wins or loses?

    Any advice greatly appreciated?

    I think there was a chap in the Tonight programme that Martin was in recently who was in the same boat. Couldn't you knock a few pound off the charges that you are due back, then you could claim within the small claims court. If you do claim the £5,000 plus figure you may be liable for other fees etc too so better to claim for a little less than £5k than claim for more than £5k and possibly be liable for other fees etc which may well eat up the amount you are wanting to claim back.   • Just wanted to mention that when sending the letter and list of charges to your bank requesting a refund you might want to send it recorded delivery as a few of my friends have sent letters and when later no response was recieved they called the bank to ask what was happening and they got the response "Sorry we have not recived any such claim you may want to resubmit your claim using a recorded delivery service."
    It's a disgrace that banking institutions are instrucing staff to lie as a stall tactic.

  • Just got wind of this over here in the USA. I am now a non resident of the U.K, been living in U.S for 4 years, still have a Halifax account...and it's still in overdraft! Is there any special circumstances or facts I have to take into consideration before starting out on claiming unfair bank charges, being in the U.S and all?

    In 2000/2001/2002 I lived in both Scotland and England and transfered authority of account to branches in each city I lived in...if I go ahead, where would I file court proceedings?

    Thank you for any help you can offer. This does sound like exciting stuff...

    (Power to the guy who sent in the Sheriff Officers to his local branch...major payback!!!!)

    Hi there, just to say I am also in the process of claiming against BOS I hand delivered letter to my own bank also claimed statements from there, statements arrived, 14 days up today for first letter but up till now whenever I have written or contacted my local branch I have always had replies etc, Maybe that varies from area to area:rolleyes:

    i am currently waiting for halifax to pay me £2600 in my bank, they said it would be 14 day, it has now passed and i have rand them 3 times to ask where my money is they said it would be in on the 20th, still not in, so i rang them again they now saying they are behind and it will be a few days late. they said it would be in friday close of play.
    Bank Charges refunded from Halifax £2600
    Bank Charges refunded from halifax joint account £554
    Credit Card Charges refunded £300 plus interest
    I'm proud to be dealing with debt!!! :T

    I would split the amount and do separate claims so for instance put in an initial claim for 2001 - 2003 and 2004 - 2007?
