    Hi there,

    Just a word of warning. I spoke to the Manager of the Customer Relations call centre, an Elaine Shaw, who told me the exact same thing, "I'll get things going for you and make sure your claim gets dealt with".

    Later when I phoned her her tune had changed, "I'm afraid it's another department that deals with that... the FSA gives us 8 weeks... etc. etc."

    For me, it was just another delaying tactic from the bank. Luckily, I followed the process laid out on this site anyway.


    Maybe you'll have more luck - I hope so!! - but I would still follow Martin's steps alongside dealing with the call centre.

    Just to remind anyone here, that if you speak to anyone over the phone regarding this, make a note of the day, time, the name of the person you spoke to and the outcome of the call.

    I presonally would advise against any such contact apart from ordering statements from the bank when reclaiming charges, keep everything in written format so in the unlikley event that the bank decides to challenge your claim you have documented evidence of every letter you sent to the bank.

    i sent my letter off on the 25th feb, got a reply on the 8th march with the 8 week time scale. sent them the 2 letter saying im taking them to court got another letter today saying the same 8 weeks, now im taking them to court.
    just rung customer relation and asked if they was going to settle before i made my claim through the court, i was told i had to wait the 8 weeks before anything was done.
    how comes people are getting theirs sorted before other

    They are so far behind and have ben sending out offers, and in some cases for the full amount, after 8 weeks. Some have been lucky and recieved a settlement before.. I would just take them to court to be honest as 8 weeks is unreasonable..

  • I posted my first letter on 15 jan and it was on the last day of the 8 weeks that i got my offer ( which was last week) but my sister who claimed 3 weeks after me got hers settled within 3 weeks??? Just doesnt make sense

    Hey everyone, just a bit confused about timescale now. Here's how it's going ;

    12th Dec 2006 - requested statements
    11th Jan 2007 - received letter informing me that statements are being sent under seperate cover and should arrive within 10 working days. They didn't actually arrive until around 20 days or so later.
    12th Feb - Sent my first letter, recorded delivery to local branch, requesting £1568 in charges (inc. interest) to be paid back. Mostly from my student days!
    14th Feb - Received prompt reply dated 13th Feb. from local branch, informing me that my complaint had been forwarded to customer relations dept. Also got complaint ref. number. :heartpuls Happy Valentines day! :mad:
    1st March - called customer relations with ref. no. to enquire about progress of complaint. Was effectively told to ignore the MSE advice, as the high volume of applications meant they'd deal with it when they could!!:exclamati:
    7th March - Ignored their "advice", and sent 2nd letter, again by recorded delivery to local branch, demanding payment in full, and threatening court action.
    15th March - 1st letter arrives from customer relations dept:shocked: patronisingly apologising, but saying that the FSA allowed them 8 weeks to respond.

    In the meantime, they have whacked me with another £56 in charges plus interest, and have set their collections dept. on me, demanding that I put my overdraft back in limit by the 22nd march or they will retrieve my cards, close my account etc.!! :eek: !!! The 14 days since my 2nd demand for money is tomorrow. I just want to know if I should take legal action tomorrow or not? With them threatening to close my account if I don't make payment by the 22nd of March, I'm getting a bit worried. I've explained to the collections dept. that I'm not in a position to pay back until the end of month, and also that I am in the process of reclaiming my charges from them! Any help much appreciated!! _pale_

    typical bullying tactic. I would advise them that as the account is in dispute and therefore the FSA and OFT would take a dim veiw of their intimidatory tactics..

    OPen another account and transfer everything over. Then tell the Halifax, who i have already claimed from by the way, that you will pay the outstanding amount once the charges have been settled to your satisfaction. Or offer to pay an amount monthly, one that you can afford...

    Carry on with your legal action and don't let them intimidate you...

    Cheers Mad, I'll be starting the court process tomorrow - presuming I don't hear from them by then! I'm in the process of opening a parachute account, either with Yorkshire Bank or Natwest, but have already applied for a Citibank Plus account. It's reassuring to know that this is just standard bullying procedure by the banks, and it definitely helps having a bit of support from these forums! I'll let you know how it goes as and when I make any progress...

    Ive recently recieved my statements back,I requested 6years worth but have only been sent them dating back until april 2004.Is this normal i did recieve them in a seperate envelope to the covering letter,Should i expect more?

    You can use a spreadsheet or use Martin's Interest Calculator the link for this is in the article. List them with date, description and the amount of the charge as this list will form part of your defence at a later stage.

    They are often sent out in batches so yes you should receive more.
