  • Yes that's right. Interest is only payable once you reach the court stage. It is statutory interest which is awarded by the court.

    im chasing bank of scotland
    for £1444 + court and sheriff officers fees i received a letter on saturday 17th march saying as a goodwill gesture they have offered me £420. i am going to phone this morning to tell them im not taking that amount i have also paid out £39 to the court and £26 to the sheriff officers so i do want my fees back can any one tell me what to do if they offer me all plus fees do i accept or push for the interest too now that i have put court papers in thanx for any help

    Don't accept anything unless it includes court fees and the interest and tell them you are going ahead with your court action.

    Hi All,

    Just to update you and get a bit of advice, I have received the letter off the halifax asking to give them 8 weeks to investigate my complaint, The 14 day period is up on March 30th should I still go ahead and sent the letter about taking them to court now or when the time scale is up.

    I'd immediatley make a complaint to the bank about them pulling your overdraft so quicky, especially if they are being unreasonable about setting up a repayment plan. If they do nothing about it which I suspect they will take them to the banking onbudsman.

    They pulled the overdraft on my bill payment account a year and a half ago due to the conduct of my account, and as a result I now have a default on my credit record. I was told then that i had six months to pay off the overdraft before they sold the debt to a debt collection agency. When I told them that i could not pay off the overdraft within six months, they told me that the best thing to do was to not make any payments to the account till the debt collection agency contacted me, fantastic advice I am sure you will agree.

    Anyway keep at them with the reclaiming of charges and good luck.....

  • hi there, newbie here but have been following with interest.

    I too received a letter telling me that the HBOS had 8 weeks to respond to my complaint letter and they would be in touch within that time.

    I stuck with my plan to allow them the 2 weeks to respond and heard nothing and issued the letter saying send me my money within 7 days or go to court. I received another letter just over 7 days later telling me that as per their previous correspondence they have until 12th April to reply to me.

    Do I wait til 12th April or do I start the court proceedings? I am desperate for the money they owe me and I am getting further and further into debt as the days pass. With a small child to support and all money being swallowed by charges is making for an unhappy life.

    Words of wisdom please?

    I had the same letter off Halifax on approx 4th March. Had another letter last Thursday offering me the money back so hopefully you'll get an offer before or around about the 30th.

    i had the same problem with this bank asked them nicely on the phone to explain the charges they could,nt.
    got no joy so i wrote them asking for my charges to be returned but they said i had signed an agreement when i opened the account with them,
    i then paid ten pounds for the last six years of statements,
    to wich arrived 5 days later i then wrote them askeing for my money to be returned to my account no joy.
    the ammount they had taken from me was six thousand five hundred and fifty pounds.
    i went to the small claims court and paid £250 court fee.
    within five days i had been offered £1450 my wife said accept it,
    i said forget it becaues if they have offered that then they have admitted
    they are wrong to days later i got a letter saying the whole ammount plus court costs would be in my account within five working days it was already in my account that day, i must stress that i had forgot to claim 8% per anum interest to which you are entitled to,
    the letter i sent them was from martins tenplate section,
    dont back down did you give the bank the right to pilfer your account when they feel like it.
    i am takeing them to court again because after chatting to them about getting things right with my account,
    they done it again. hope this helps dont give up

    Afternoon all , just had a call from HBOS telling me the statements I ordered for my 2 accounts will be with me by close of business on the 24th Feb ... its goin to be a busy weekend the 40 days is up the day before too ...:beer:
