Can any Halifax customers help?
I notice on one letter I got from Halifax saying that I was going to be charged £30 for failure of a direct debit. This I am attempting to claim back.
It then says that it will charge any debit interest on my overdraft. This we all accept as part and parcel of an overdraft.
It then says that the monthly unauthorised interest rate will apply to the amount which is in excess of the agreed overdraft. Is this something that I can reclaim also? If yes, how do I work that out. I have had a look on my statements and it doesn't seem that clear.
I would welcome any thoughts / advice.

Amount Claimed: £1827.81 (inclusive of 8% interest and court costs)
Amount Refunded: £1827.81
Story:
Just followed the tried and tested method of reclaiming charges via the templates, and with the valued advice from this site and from penaltycharges.co.uk. Had to go as far as filing with the court, but cheque received today. Total time from sending my DPA request to receiving the refund was 79 days
Did they any £12.00 charges or were the individual charges higher than that?
Would help me to decide if to claim or not.
Most of my charges are 'overlimit' and 'late payment' chrages from recently. All £12 each.
Any pointers from anyone gratefully received.

I have just received a letter from HBOS saying that they cant process my request for back dated bank statements (it took them 32 days) as I didn't enclose the required £10 fee.
I most certainly did enclose a cheque with my letter, so is this a new appalling tactic by the banks?. Throw your uncashed cheque away and pretend they never got the thing in the first place?..So what do you do in these circumstances?0 -

With regard to not sending away statements, although Martin's step by step guide doesn't mention anything about sending them away, I used the letter templates from the BBC's Money Programme site because the wording on them seemed a little more "legal" and that site recommends sending highlighted statements with your claim.
As long as they are presented with document evidence of what you're claiming I don't suppose it really matters.
It does matter when it gets to a later stage. When you have to fill in the AQ at the court stage you need to send a list of your charges with dates and descriptions of each charge and the banks solicitors may well ask for a copy of this too.0 -
i sent my request for my charges (statements) using the template from this excellent site, this was 2 weeks ago and havent heard anything yet, my cheque hasnt been cashed and halifax havent been in touch yet. i know we give them 40 days but what seems to be the common time span for them arriving. i did make the mistake of not sending by recorded though. should i resend and by recorded or just bide my time till the 40 days are up. like most on here i have had bad credit over the years so have found it difficult to open a new account and this has been the reason for my request now and not when all this came to light about reclaiming. i need to get my statements as ive calculated the charges for the past 2 years (statements i have) and they owe me over £1500 so i know it will be lots more for the previous 4 years to that as they were my really bad years.halifax bank claimed £4803 (£5863.88 inc%) paid £6143.29 :j

We waited nearly 4wks to get the statements, we did receive a acknowledgment letter after about two weeks. I would just hold of and I am sure that you will get them. As you say they do have 40 days to reply. With regards to Recorded Delivery I would certainly recommend sending any future letters this method.If I have been helpful - Hit the Thanks button0 -
Having sent the Halifax my claim 12 days ago, I have just received a reply thanking me for my complaint and stating that the FSA allows them up to 8 wks to investigate and respond. I presume this is just another tactic??? will someone please confirm that this is the case and that I should now continue with court action.

They are just at it! I assume that they have not cashed the cheque? I would send another cheque for £10 but insure that you send it recorded delivery. That way you have proof that you have sent the letter.If I have been helpful - Hit the Thanks button0 -
6/3 After some sorting and photocopying claim for £5250 and copies of the statements containing charges are sent 1st class recorded delivery to my local branch. I give them a day for the letter to be delivered so I make the
14th day Tuesday 20th March.
16/3 I have received the standard acknowledgement with the usual 8 weeks to look into your complaint etc. etc. I cannot find out using the track & trace function at the Royal Mail when the package was signed for.
My question to fellow board members and I think I know the answer already, is do I give them 14 days from the date on the letter which is the 15th March or carry on with my own timeline.
I'd be very grateful for some feedback on my earlier question please.

Hi all
Ive just got to the 14 days nearly up stage to filing court papers on halifax. I'm trying to claim back £1745.00 from them (including interest).. would I be correct in offering to reduce my interest fees down by 50%..? this may make them decide to offer me money before issuing court papers to them.. any help would be appreciated0
