I posted my third letter to them today, reminding them that they only have 40 days to send me details of my charges not 8 weeks. Their definitely having a laugh this lot.0

I am currently reclaming bank charges totalling £3296 pounds from the halifax.
I have 2 accounts with them and i decided to do it in 2 seperate claims. One account has £723 in charges the other has £2573.I used the interest calculator on this website to calculate the interest which comes to £109.75 on the first account and a whopping £822.39 on the second. I knew that there where a lot of charges on the second account so i started by telephoning customer services and asking for the last six years statements on the first account which they said would cost me £5 and would be delivered within 7-10 days (which they were).I then wrote to them after totalling the charges and adding the interest asking them for a refund within 14 days and got the standard "we are unhappy to hear of your complaint-heres a lovely leaflet" response. I then rang customer services and asked them for 6 years statements for the second account which i knew had a lot of charges on and again they came in about a week. So i totalled the charges up and calculated the interest-again i printed the table of charges and interest and sent the letter for my claim as the first account and this time i sent a second letter about not receiving a satisfactory response for the first account. This letter has a Without Prejudice offer of my gesture of goodwill that i will accept the refund of charges and will waive the interest that i added if they settle before court as i knew they would get this the same time as the bigger claim with over £800 in interest-hopefully they will put 2 and 2 together and pay up before it goes to court (which it will) as they know that theres nearly a £1000 worth of interest that i will waive if i get a full refund. The second letter went off last Wednesday (the 14th march) so they have til the 28th to sort it or it goes to small claims-i'll keep you posted on events-Good Luck everyone!0 -
Hi all
I sent a letter off last week requesting my bank statments, but to cover myself I thought I would pop into my local branch of the Halifax and ask them for the statments, wasnt sure where it would get me but worth a go.
Anyhow, I asked the lady for statments going back 6 yrs, so she looked on the computer and said that will take you back to January 2001, I said thats fine. She didnt mention any payment but said they will take up to 10 days to get to me. Phew was it that easy.... As I was leaving she said to me that when I get them, I can bring in my 'letter' and they will send it onto customer relations...so they are obviously fully aware of all this going on.
Good luck to everyone and thx to all the hard work going on in here to make this all work...

hi all

I gave my letter to somebody to post for me on the 22nd of February but it only got posted on the 26th or 27th. I thought that it was posted earlier so i rang through to the telephone banking number 08457203040 and went through to the option to speak to an assistant i think it was this Monday or last Friday they told me that they had nothing on me but would put it into action and i wouldn't have to pay anything. Four or five days later my statements turned up.
I sent my letter today but i modified it a bit lol-
This is what i added on the end lol.
I would like to request a refund of all the default charges that have been applied to my account.
Under the Unfair Terms in Consumer Contracts Regulations 1999 charges must reflect administration costs and cannot be punitive. I believe that the following £1,534.30 are unlawful as they do not reflect the true cost to Halifax Bank.
The charges total £1,234, plus as I believe I have been unlawfully deprived of the money I have calculated £ £307.30 interest at the statutory rate the amount the court will award. I am requesting repayment of this £1,541.30 total sum. I also ask you to ensure any default notices entered against my credit record are removed entirely, thank you.
I cannot settle for the a good will gesture the full amount above has to be repaid. I have received my six years of statements from your bank and accountant went through them and the charges above is what is owing to me. I would appreciate if this is dealt with asap.I have attached a full schedule of the charges and interest with this document.
I look forward for a full response to this letter within 14 days.
Yours faithfully,0 -

This is a common delayig tactic. Just stick to your timetable and don't let them sidetrack you. Remember, you are the one calling the shots not them.0 -
