I have been posting all over the place but this seems to be the right thread now!!
I have had 2 letters from the Bank of Scotland: the first saying they will deal with my claim within 4 weeks; the second (after the 4 weeks were up) saying they apologise for the delay and that they will respond (again) within 4 weeks. I have had enough and have just written the letter threating them with court action. I have been corresponding with the Customer relations department but before I fire off the next letter can anyone tell me if this is the right course of action or should I try another approach (e.g. going through MCOL, or writing to Halifax head office)?
I am trying to get action before the OFT publish their suggested figure so a rapid response would be much appreciated. My first letter to them was the 2nd February for £1,654.
For those wondering about statements I had them arrive in different ways: statments from 2001-2004 came in 1 envelope but the remaining ones arrived a day letter but I received them in 12 different envelopes!!!! Thats what they are spending our bank charges on, post!!!! :rotfl:0 -
Hi there - Well, Halifax/Intelligent Finance had until 1st March to respond to my small claims case and they didnt, so yesterday I applied for a default decree against them. Has anyone else had to do this...I am now waiting to hear what happens next. I was really hoping to be one of these people they just settled with asap.
Getting a bit scared now and wondering if I'll ever get my money!!!0 -

HI Guys,
Need a bit of advice, i started this procedure 2 weeks ok, by asking the Halifax for a copy of my statements.
Well i thought i would give them a buzz today to see how they where getting on.
The man i spoke to said that they had not recieved the letter and could not help the postal system he also said is hould cancel my cheque as halifax only charge £5.
He then said i shoud redo the letter and deliver it by hand.
What do you guys think??
I think they are stalling me coz of the legislation that will be coming.
I know how much charges i have for 2 years as that's all the statements i have, what should i doAugust

I just contacted the Bank of Scotland through their telephone banking and am getting six years of statements for a fiver, :j so anyone lookimng to get statements from them should use this avenue rather than send them a letter.
I also asked the telephone banking operator what address I should use for correspondance to the bank and she told me to write to :-
HBOS PLC
PO BOX 548
Leeds
LS1 2AP
I would advise anyone to send any mail to the bank via recorded delivery, to ensure tracibility. I know from bitter experience with the Bank of Scotland that letters sent to your branch will not be answered or entered onto their system at all.:beer: "I'm Just A Demin Boy":beer:

As soon as i phoned....they took the fiver.
exactly 10 days later i got the statements, in about 20 different envolopes....( They are not bright enough to send it in one big envolope to save on postage costs)
They told me 7-10 Working days
My letter went out 4 days ago asking for charges + interest, they have 10 days to reply before i send my other letter to them. Iam doing this through my local branch so i definatly know Halifax recieve it.Halifax Result! Amount Recieved £1152.00 Inc Interest & Court Fee
Capital One MCOL Issued - Awaiting Defence to be filed.
Barclaycard Reported to the information commisioner for a breach of the data protection act 19980 -

Think you can go in to your local bank and request your statements, should print them off for you there and then. Worth a try. Good luck!0 -
