Hi ...I did exactly the same and started court proceedings.....LOL Person was very polite on the phone but nothing had been done on the court and they advised I could carry on with proceedings.....fool!!
Today I received a letter offering £1409.00 as final settlement but I am going to reply ( very nicely) that "unfortunately after speaking to you customer services representative and letting her know I was about to start court action, she suggested I contiune with court proceedings and therefore would accept this as part payment and would be continuing for the full amount with interest and court costs".......thats fair isn't it!!0 -
Have recived my reply back from halifax today saying the complaint handling rules set by our regulator,the financial services authority,gives us 8 weeks to investigate and respond to complaints.
does this mean i have to wait 8 weeks before sending off my next letter(last one was asking for charges back)

This is a standard letter from Halifax, you need to stick to your timescale and send your next letter.0

the halifax have responded to my claim for 958 big ones by claiming they have eight weeks!!! to respond to my complaint. after making me wait out the 40 days for my statements i am much aggrieved by this. do i have to wait? should i just refute their right to do this or just carry on and send in my application to small claims? Anyone got any ideas?0

You need to send the next letter saying you are now taking them to court.0

I have read the articles on reclaiming bankcharges and found it very interesting.
I too am in the process of reclaiming ... fingers crossed
Bit of advice to anyone about to do it, send your letter by recorded delivery! this will prevent bank from ' misplacing or never receiving your letter!' then you have additional evidence of when you sent it
Also i have a question..........
Im with sh***y Halifax (excuse language) because i have a online account a now have a paper free service, this means that i dont receive letters from bank about charges as it is a ' paper free service ' .Nor do i receive any notification of any charges or missed payments?
So how on earth can s****y Halifax charge me for charges when i dont even receive mail from them and they dont even have to lift a finger!
To be honest its my error if payments aren't made and i understand that but to charged is criminal.
Also by the time a charge registers on the online account with notification of charge in writing ( thru automated sending ) the direct debit is attempted again within the time it takes it for me to find out therefore i get charged twice!!.
So this month i got charged twice for a 34 pounds bill that was attempted to be took out 4 days early! 11th instead of 15th
So this means that i got 2 x 38 pound charges = 76 pounds!!!!!!!!!!!!!!!!!!!!!
I tell you what it is i hope the CEO of Halifax chokes on his cigar !!!!!!!
and thats putting it mildly!!!
I hope you all screw the banks for over charging and good luck peeps

I sent 2 cheques for my 2 account , both for £10 and they cashed both ...still no statements and how can others be charged only £5 ? looks like they owe us an extra £10 ...Im not really mad...0

You need to look into this you have paid 2 x 10 pounds if your date of letter has gone past the 40 days look at the other posts it states you resend a letter giving them 7 days to reply with charges it also has a commisioner bit on the end of letter thats the letter you need:money:0

Just off the phone to the Halifax, woman was trying to test how daft I was. By asking why I sent £10 to them, what info am I wanting (erm?????my bank charges!!), according to het there are very 'dubious websites' (LOL!!)out there (TAKE NOTE MARTIN!!) that are telling people to send £10 to the banks, when it costs £5 and that I will not get my statements until 40 days AFTER my cheque has been cashed not 40 days since the letter has been sent. LOL!!0

i'm annoyed with Halifax! i rejected their goodwill gestures on 2 of my accounts via recorded delivered letters, i can see they have received them from the royal mail website, but having phoned them today to give them ONE MORE CHANCE before i continue with court proceedings, they say 'we dont have any record of receiving your letter'. IDIOTS!
they have backdated my rejection to the date i know they received my letters and they are going to "issue a response by the 15th March". I think I will be submitting the money claims today.
