    If you have sent the letter before action then yes you need to start the court process.

    Also, to make things (appartently) easier, i sent in one letter with two accounts, my student account and current account, totalling £1700. I am in scotland where the max small claim is £750, can i split this into two (one for each account) small claims, or maybe more to keep them under the 750 limit. (as i dont want the halifax to keep any of it)

    We'll worry about that if we come to it :)

    A lot of questions i asked i know, but please help.

    Hello There,

    On Monday I sent the letter to the Bank of Scotland Customer Services centre in Rosyth, and am rather impatient at getting a response from them, as on my 2 accounts with them I think they could easily be up to £3000 worth of charges to reclaim.

    As I said I have two accounts with them one was a bill payment account which I have an overdraft of £450 which I am paying off at £50 a month. This account worrys me the most, even though I am up to date with the agreed repayment schedule. If they offered a settlement is it likley that they will only offer me a settlement of the amount outstanding on this account only? and is there anyone on this board who was in a simular position with this bank.

    I also read elsewhere on this board that the bank of scotland have closed custormers accounts and prensented them with a bill for the outstanding ballance, if they do this should I take it up with the banking onbudsman?

    I am interested in hearing from anyone who has been through the entire process of reclaiming bank charges from the Bank of Scotland, so that I can get an idea of what timescales they operate on, so I can plan what action to take and when. I am not willing to let them stall me.

    I know from bitter experience that custormer service from the Bank of Scotland is quite simply atrocious (especially since the merger with the Halifax), and any constructive suggestions on how to deal with them would be most helpfull.

    Bank Of Scotland Charges
    Current Account Claimed :- £1400 plus interest
    Offered :- £648
    Accepted :- £1400

    Bill Payment Account claimed :- £3800 plus interest
    Offered :- £1900
    Accepted :- £3000

    What letter did you send to this address as this address is the Credit Card section/call centre.

    I have went through all the statements that HBOS sent me and I have charges totally £2742. Now I am about to send the second letter, But how do I calculate Interest on Overdraft. I have interest debited as notified on my statements is that the figures I use.

    Any help would be great

    Just been told by Halifax that they have a major back log and that it is taking at least 21 working days to respond!!

They said that they no longer had them for the time before them as they had been deleted due account maintanence or something (im looking for the letter to get the actual wording. Basically they deleted them to free space was the jist of it.

    Is this legal and right? Im claiming for the dates i had, but what about the ones that they did not provide me with?

    I have just typed my first letter requesting statement of charges only, also to the Halifax so will be interesting if I get the same response. Let us know how you get on. I will let you know if I too get the same reply.

    I am claiming just iver 5000 from bos 2nd letter sent and was just wondering what my chances are anybody else from scotland tried to claim this much from them and won doing it through scottish courts ???

    You can't claim the interest you pay on your overdraft. The interest Martin talks about is the interest on the bank charges you are claiming. Please read Martin's article and listen to the audio file within the article. There is also a post regarding interest in the Reclaim Help Thread, links in my signature.
  • hi! new to this and a wee bit lost! i just got my 2nd letter back from hbos saying that they were still investigating my complaint, will reply as soon as but not after 26th march, blah blah blah, i phoned them and asked why they were taking so long and was given the dummy card answer, ( very busy, backlog etc etc) i now want to start court action but not sure how to go about it, the ammount in total including interest is approx £3,300. tried looking around the site but seems to cover england and wales but cant find any info on how to claim in scotland ( small claims only seem to go up as far as £750!) any help would really be appreciated!
