    Have a read of this thread Reclaiming in Scotland as you should find most of the answer in there.

    Please don't let the problems of claiming via the court system worry you as yet, just start your claim as there will be plenty of time to worry about that later.

    As 2nd March is only a few days away, will I send my next letter, or wait to see what they say.
    I don't want to scupper my chances.
    In my second letter, shall I give them 5 working days to pay, as they have already had the best part of 8 weeks?

    Just wanted to tell you my update so far.

    Followed all the steps from asking for my statements to asking them to pay me my money back and threatening them with court. Halifax owe me £2788.29 without interest. never got a reply from them, then i rang them 2 times asking why they have not replied when i gave tham 14 days, they said they had 8 weeks to respond to my complaint. Which would of made it the 13th March. Yesterday got a letter from them (shock) refunding me £2383.00. this is a couple of hundred short for what i asked for. i will be phoneing them on monday to ask why i havent got the full amount. but im really considering taking what they have offered me.
    Bank Charges refunded from Halifax £2600
    Bank Charges refunded from halifax joint account £554
    Credit Card Charges refunded £300 plus interest
    I'm proud to be dealing with debt!!! :T
  • My OH sent letter off asking for bank statements on 29th January. Cheque was cashed on 7th Feb. So far he has had absolutely no response!! No acknowledgement zip!! Hoping this does not mean we have a fight on our hands. In everyones experience do HBOS send any acknowledements or eventually do the statements just appear. Not too concerned yet as 40 days aren't up. They have 10days to go then we will follow up!

  • have just got statments back and i am posting my claim to halifax tomorow
    £876.00 & £228.35 interest total £1104.35 wil let you know how i get on

  • Hi im a student in final year at uni.
    i have a current account and a credit card.
    both with the halifax.
    On my current account i have a o/draft of £600 which i live in a lot of the time will this matter.
    On the credit card it has been on the limit for several years with late payments and fines for going over the limit will this matter in there desiocon to give me my money back.

    im just a little worried that because im not there better customers that they will just force me to pay up o/draft and credit card and that would be a disarster. I plan on making myself debt clear arfter graduating but this would help me along the way

    They will repay your charges, they may cancel your card however this is unlikely. I would advise that you do reclaim your charges it may be enough to repay them. ;)

  • I Would Say Just Go For It, There Are No Guarantees That They Will Not Close Your Acc & Take Your Card Away But You May Aswell Try & Cross That Bridge When You Come To It!! :o x

    So, I went through my statements and sent off to ask for my money back. I got a letter back saying that they received my letter dated 12th October 1200! Also, they said I'd receive a reply within four weeks. Time is very nearly up - what do I do if they don't reply?
    Only when the last tree has died and the last river has been poisoned and the last fish has been caught will we realise that we cannot eat money.
