  • Im hoping to claim back charges + interest totalling £550, but following my goodwill gesture of £290, I followed some of the advice of others on this site & rang up customer relations in an attempt to settle prior to sending out the next letter (threatening court action).

    Unfortunatley I was not as lucky, and as nice as the lady was on the other end, she wouldn't budge and stated that £290 was a fair offer, as it was approximately half of my claim amount - excluding the interest of course - of which I am trying to claim back.

    She also stated a lower amount of charges compared to what I had calculated? I have checked, & double checked my charges again and can't understand where the amount she mentioned came from?

    Regardless, I am sticking to my original totals and will be sending the next letter off today.

    Am I doing the right thing? Unsure?

    Maybe you could phone again and ask them to send you a copy of the charges THEY have? I was offered a 'goodwill gesture' of £250 and I phoned and said I wouldn't accept. They asked what I would be prepared to accept and I said I wanted the whole amount inc. interest (just over £500). I was told at this stage they would only pay my charges,and as I'd missed out a charge these amounted to £468. I sent the acceptance letter off last Thursdayand the money is in my account today! p.s they went over the charges on the phone so have all your paperwork with you when you call. Good luck!
  • I have just tried to claim charges back from the Halifax.
    I tried to claim £70 worth of charges and £192 worth of debit interest. So far I've been offered £70. Am I entitled to claim back debited interest, or should I take the £70?

    .....yes Karnam, there are many success stories on here. Have a look at the Success Stories thread - it's an inspiration, it's informational and it's an interesting read.

    No bank has been confident enough to challenge in court yet, so all of the success stories are without a court appearance... they may threaten it, but they have yet to follow through in England or Wales - they have always settled out of court.

    Not completely true I'm afraid.

    A claimant appeared in court and lost just over a year ago in England. This is unlikely to happen again under the same circumstances though.

    ... nickmack, thanks. If you know the circumstances, could you briefly jot them here for the benefit of us who don't know? It could be a benefit for us newbies, and certainly interesting. I was under the impression that the only case seen in court was the Capital One case in Ulster :o

  • Hi guys 'n' dolls. I knew I'd been charged a fair old whack by the Halifax over the last 6 years in back charges but I've totted them up and it comes out at over a massive £3,000!(and I'm still missing 9 months of statements too between 2000 - 2006)!

    What is the 1st step in dealing with the Halifax in claiming this back? A letter? If so what info needs to be wrote in it? Should I just walk into my local branch and ask to see the manager? Should I contact a solicitor or some online agancy that can hlep me? For example what is the consumer group or whatever it's called about and how do they help?

    I AM a total novice at this type of thing but there's no way I'm letting the Halifax get away with this . I've been a good,loyal servant to them for years!

    Any help at all very much appreciated guys!

    I sent a letter on 31/01/2007,requesting a refund of all charges plus interest,giving 14 days for a response,on monday 19th February i received a phone call with an offer of £1100,i said i would need time to consider this and today after phoning them after much discussion explained i would not accept this offer and would start court proceedings,at this stage a 2nd offer was made of £1498 all my charges refunded and the lady at the Halifax was very polite and helpful,so hang on in there and dont give up.

    First request your statements for the last 6 years,on receipt use theStatutory interest calculator on this site to work out all charges plus interest,print and send this to the Halifax Head OFFICE NOT THE LOCAL BRANCH with the letter also on this website requesting a repayment of all default payments and 14 day s for there response.Idid this on the 30/01/2007 and on the 19/02/2007 had a phone call with an offer of £1100 which i said i would think about,today i phoned the Halifax and declined there initial offer and a 2nd offer was made for the full amount of charges of £1480, i have settled for this as this is more than i ever expected thought i would never get anywhere,it works as a computer novice i found it very easy to follow and do.Hope this helps you,go for it and good luck.
