  • Got refused...'we're sorry you're unhappy blah, blah'. Sent the 'pay me in 7 days' letter and instigated the court procedure through money claim. What happens now....?

You can follow your claim online. It will show you the status of your claim. The bank has 14 days to acknowledge the claim, and another 14 days to enter a defence if they acknowledge.

Sent my letter off with details of all charges on the 10th Feb and what did I get in the post this morning, my letter returned with an enclosed 'compliment slip???!' saying enclose £10 and return!! Just that, no explanation as to 'why' I should give them another £10!!

Straight down to local branch telling them that no way was I paying them another £10, was told 'Head Office won't process this without the £10' suggested they read the letter as I wasn't asking for my statements as I've already received them, but the charges. Another delaying tactic perhaps??? Told them that they'd wasted a week as I still wanted a full response by the original date in my letter!!
  • I cant find my original thread (can anyone tell me how I do that please?!)
Sent letter1, got the standard 'no' reply, send letter2, gave them another week after the 7 day deadline, just about to start the court claim online process when I realised I hadn't dated letter2!! Figured their lawyers would have field day with that and I might end up losing the claim so re-sent letter2, with the date, yesterday.

  • They have just sent me an offer of £187.50, representing half the charges in one year. I don't think so!!! Not when they owe me £1080 plus interest! I'll be seeing them in court methinks.
  • I can't believe that I still haven't heard from Halifax. Every letter I send I don't even get the standard reply's like you guys are getting. It has been nearly 3wks since I threatened court action and all my letters have been sent reorded delivery. I have checked to see if they have been signed for and they have. I was hoping to avoid court action as I have to rob peter to pay paul. Well looks like I have given them time enough so I will be submitting MCOL start of week. Has anyone else had this problem of the bank not responding????

I am in a similar position. The Halifax has not so much as acknowledged my initial request for a refund, or my following up with an offer to settle in it, and saying the date I would go to the small claims court. I would probably accept any halfway decent figure in settlement too!

I got the same response from Halifax, that they would respond within 28 days after I initially stipulated 14. I took the attitude that if it has taken 6 years, another 2 weeks MAY just help rapport, while not really making much overall difference to me. After 26 days I had an offer of 100% of the claim with an acceptance letter for me to sign. It's only right to be reasonable with them - sure they are in the wrong but the guys are swamped at the moment. Give them their 28 days, and pray that no bank defends and wins in the meantime.

    cheers,

Thank you - will do. Well done for getting all your money back, hope I am just as successful! :D
