    My questions are:

    a. is it worth ringing back hoping to speak to someone else to see if they will offer full amount

    b. do i send the offer back as a complete NO DEAL or accept as part payment
    and go for the rest through court. They have till 28/2/07 to file a defence.

    a. Probably not. I would leave this to run it course now. They will probably offer the full amount you are asking for anyway (next).

    b. If they pay you the money, you can accept this as part payment, but continue your claim for the full amount. Only change the amount of your court claim after you get any money from the bank. Do not change it if they make an offer by post.

  • Thanks Rex for your reply. Will the Halifax have accepted my refusal to the offer over the phone today, as the bloke i spoke to seemed a bit clueless.

    Or do i have to send them it in writing, returning the acceptance forms unsigned.

    Posting same question again as didn't get reply..is it best to ring up and ask for my charges refunding as its such a small amount (4 charges in 2004-2005)? Or is this not following proceedure so they'll say no?

    Am I the only one wanting to claim so few charges back? I know its only a small amount but it's my money,however small and I want it back!! One of the charges came about after I went 1p into my overdraft!!! I think it's worth doing it just to get them back for this lol

    Depends really on how much your interest is. I accepted an offer of £468 which was just my charges. That was after my letter requesting my money back. Initial offer was £250 so I phoned and said I wouldn't accept. Halifax asked how much I wanted. I said the whole lot inc. interest. They said I could have all my charges back at this stage, but they wouldn't pay the interest. I was happy with that 'cos I was only claiming just over £500,, but I appreciate your interest could be a lot more. We all know you'll win if you go to court so you'll get the interest that way, but we're all different and for some the idea of going to court puts people off even STARTING this. Good luck!

    I Issued Court proceedings against Sainsbury's BANK PLC (HBOSplc) ON THE
    2nd February. I received a Notice that Acknowledgement of Service has been
    filed dated 8th February. It states that the Defendant now has 28 days from
    the date of service of the claim form to file a defence.
    Response Pack n9cpc has been returned stating that - I intend to defend all of this claim. Signed A.O'Brien (AOH) Defendants Solicitor Head of Legal Services.

    What next ? Any advice on this please

    Court fees - £120

    Halifax have agreed to pay this back to me, so i signed the acceptance letter and sent it back and i was told the money would be in my account within 7-10 days - 14 days later still no money and getting fobbed off with "we are inundated etc etc - so so busy etc etc"

    So seeing as though i filed with money claim online, i have now requested judgement of the full amount plus interest which totals £4184, as halifax didnt bother to acknowledge my court claim.

    Question is - do you think the Court will uphold and make them pay the full amount ? I know i have signed a form saying i will accept a lesser amount - but i havent received any money from them.

    And seeing as though Halifax didnt even bother acknowledging my claim - judgement by default is automatic and final isnt it??

    Any advice would be appreciated.

    If the acceptance form that you signed stated the money would be in your account in 7 to 10 days. Then because they haven't paid yet, you would be within your rights to not accept this offer now. They would have broken the terms of the agreement you signed when you accepted their offer.

    If it didn't say on the form anything about the money being paid within X amount of days, it seems a bit more tricky. They have a signed agreement that you have accepted their offer.
