A genuine error I would say, despite what people might think I really don't think the banks are thinking up delaying tactics
Depends when the 5 day response time is from, today when you phoned or has it already started? Would be worth giving them a ring again tomorrow to see what is happening. Generally if an account is open the offer will be put into that account, not sure about you being "entitled" to ask for a cheque but you could ask them what they normally do.0 -

The only reason I asked about the method of reimbursement is that I am in arrears on other accounts but not this one. I wanted to pay those off to strengthen my position with regard to the claims on those which I have yet to commence!!!

In total I have claimed £759 from the Halifax and received two letters offering me the amount I requested minus the interest. Interest was not much so letter of acceptance is now in the post ! :beer: :T

LBA sent and they offered me full amount minus interest before the 7 days was up!

If you owe a bank some money and you are either in default or it is an overdraft (which is usually repayable on demand) then it is very likely any refund of charges will be offset against the debt, even if it isn't on the same account. I think that this would be deemed reasonable in a court. No bank is going to pay you £x if you owe them £xx!
In your case Dan you suggest you are up-to-date with your credit agreement. You may be lucky.0 -
Hi,
I sent my letter this week including a printout from the site which calculates the interest. In the letter I stated that the list was for all late standing order and direct debit charges for the last six years but i did'nt mark each charge individually. Do you think that stating in my letter what the printout is about in a general manner is enough or should they have been marked out seperately?0 -
They may come back at a later stage and ask for a description of each charge but as you have sent it now I wouldn't worry about it yet.0

I phoned up Halifax card services and told them I was refusing their 50% offer and I expect to receive 100% or I will take them to court and be claiming 8% interest. Two seconds later they agreed over the phone to refund over £500 (100% of my claim.)
I got the name of the person I spoke to, and an agreement that a cheque would be with me in under seven days.
I faxed them with details of the conversation and said if there were any disagreement with what was said contact me. No money in seven days = immediate legal action.
I take it I've won? Or have the halifax been known to pull any fast ones? Can't believe I may have actually have got my money back.......0 -

Just to follow up on the 'by law' bit. The Financial Services Authority guidelines lays down certain timescales by which financial institutions should respond to complaints. These 'guidelines' are NOT the law, and if Halifax or anyone else says it is the case, they are wrong. Don't let them fob you off!0
