    Not sure which letters you have sent already but I'd be sending another letter now, follow your timescale not the banks.
  • I have sent my branch at the halifax the first letter requesting £1009.00 plus charges but I have still not heard from the branch.

    I am currently sending a second letter threatening court action. Could somebody please advise if I should be sending the letter to my local branch where I opened the account or to the main Halifax registered address???

    I'd phone your branch and check if the letter has been sent to the relevant department and ask them the address to send this next letter to.

    Ive sent the second letter taking them to court, but they have said they have received my claim but will respond to it in 8 weeks, i told them i gave them 14 days to reply they said to me by law they have 8 weeks, so i said i will be sending them to court.

  • In fact its not a law but a recommendation by the Financial Ombudsman that they respond to complaints within 8 weeks (or whatever time the bank says) so you just carry on.

    Once again thanks for the advice,

    With regard to the method of reimbursement (once again hee hee). Due to the fact that my claim for the charges outweighs my existing balance could I not use the argument that I have, in effect, already paid these off my balance once and therefore be allowed to have the reimbursement as cash and not paid off my balance?

  • Update to my previous post - I have received two low offers for my 2 accounts since my mcol was acknowledged on the 12th feb.

    Account 1. Money claimed with interest £1,076.23
    OFFERED £435.00

    Account 2. Money claimed with interest £773.28
    OFFERED £348.00

    Total claim £1849.51
    Court fees 120.00
    £1,969.51

    Got the usual letter about their charges, blah blah blah, and at the bottom saying if i was not happy with the offer to ring the number at the top of the letter.

    I rang, explained i was not happy with the ammount offerered and would not accept. I was asked what i would accept, i said full amount. He then came back offering without interest, to which i said i wanted full amount including interest and court costs.

    The reply was that they cant pay interest or court costs, when i objected he waffled on about I might not win anyway in court, so i told him i would take that chance. He admitted to being new to the job and to ring back if i changed my mind- Not a chance.

    My questions are:

    a. is it worth ringing back hoping to speak to someone else to see if they will offer full amount

    b. do i send the offer back as a complete NO DEAL or accept as part payment
    and go for the rest through court. They have till 28/2/07 to file a defence.

    Sorry for being so long winded just want to make sure i use the correct proceedure.

    Just wondering if anyone else has had the same response as I have.
    I sent away the first letter requesting a list of my charges/ copy statements etc.
    I received a letter back from them (addressed to my husband may I add) stating that they would look into my complaint etc within 28 days. That was 20+ days ago and received another today saying that they are still looking into my complaint etc and that the complaints leaflet would explain their procedures .
    Well I never made any complaint did I? I simply requested a copy of my charges. Obviously they know why I want them, are they just trying to employ stall tactics??
    They have until 3/3 to provide me with the info so I suppose there is not much I can do before then.
    Has anyone else had these problems simply trying to find out what the charges are?

    Hi Monkeypants,

    You may want to clarify this with a more experienced member but to my knowledge, if they do not comply with your statement request within the forty days then you can complain to the Information Commissioner.
    They are getting way ahead of themselves here and shouldnt be so presumptious. They are duty-bound by statute to provide you with this information and shouldn't be second-guessing what you intend to use this information for.
  • Im hoping to claim back £550 (inc interest) in charges, & have so far followed the very useful template letters provided on this site. I sent off my letter requesting the above amount with the breakdown of each date, amount etc.

    Within a week, I received a letter from customer services stating that they were sorry I was unhappy with the charges, and they would respond within 4 weeks.

    3 weeks have passed, but today I received a phonecall from the Halifax with an offer of a goodwill gesture of £290.

    As the call took me by suprise, I declined the offer and said I would rather look into the issue further. They said they would send out the acceptance letter anyway, and should I wish to accept then I could do so.

    HAVE I DONE THE RIGHT THING?? I know £550 is a comparitively small amount, but to me £290 was unreasonable as a goodwill gesture.

    Has anyone else had the phonecall - should I not have answered it and perhaps they would have offered the full amount in writing??

  • I doubt they would have offered the full amount by writing either. If you don't want to accept the offer you need to write back and say you will now be proceeding to court.
