Then because they haven't paid yet, you would be within your rights to not accept this offer now. They would have broken the terms of the agreement you signed when you accepted their offer.
If it didn't say on the form anything about the money being paid within X amount of days, it seems a bit more tricky. They have a signed agreement that you have accepted their offer.
You know what - i think i will just wait and see what hits my account first - the lesser amount of the full judgement amount with interest. Im just so fed up with the bank calling the shots - but as soon as it hits my account im bouncing it straight out into my parachute account as it didnt state on the form any time limit for payment although i have been told a number of times verbally on the phone its 7-10 days (although i know they have now upped this time limit to 14 days for new claims).
will keep you updated as to what happens!

I think you should realise that all the banks are probably swamped with claims. It doesn't surprise me to see them missing their own deadlines. How many surrealists does it take to change a lightbulb?

I sent off the letter requesting £700 odd quid in charges and got a very polite letter, saying they will look into it and get back to me within 4 weeks. But I am sticking to my 2 week deadline and if I don't hear what I want to hear, shall send them the letter threatening court action. I got the same response from Halifax, that they would respond within 28 days after I initially stipulated 14. I took the attitude that if it has taken 6 years, another 2 weeks MAY just help rapport, while not really making much overall difference to me. After 26 days I had an offer of 100% of the claim with an acceptance letter for me to sign. It's only right to be reasonable with them - sure they are in the wrong but the guys are swamped at the moment. Give them their 28 days, and pray that no bank defends and wins in the meantime.

yorkshirerose wrote:Thanks Rex for your reply. Will the Halifax have accepted my refusal to the offer over the phone today, as the bloke i spoke to seemed a bit clueless.
Or do i have to send them it in writing, returning the acceptance forms unsigned.
Thanks again.

Posting same question again as didn't get reply..is it best to ring up and ask for my charges refunding as its such a small amount (4 charges in 2004-2005)? Or is this not following proceedure so they'll say no?
