o2 now charging me for MMS, when they used to be in my text bundle

    Probably not, other than for the last 4 years they always have.

    Me either. I've been with o2 for about 9 years and they've never sent me a letter or anything when I've upgraded.

    They also don't have any proof I agreed to the contract, I didn't sign anything when I upgraded.

    According to o2's terms and conditions, you should be able to cancel your contract.

    14.3 Subject to clause 14.4 of these General Conditions, the Customer shall be entitled to terminate a Service by providing 30 days‟ notice in writing if:

    (a) O2 increases the prices and/or tariffs set out in the O2 Price List and/or the Commercial Schedule in respect of that Service pursuant to clause 12 of these General Conditions and that increase is to the material disadvantage of the Customer (for the avoidance of doubt an increase in prices and/or tariffs of 10% or less in any 12 month period shall not constitute a material disadvantage of the Customer); or

    (b) O2 substantially varies the terms of this Agreement that relate to that Service pursuant to clause 12 of these General Conditions (including the Commercial Schedule) and that variation is to the Customer‟s material disadvantage,


    I read that as, if they make a change that will cost you more than your agreed contract, you can terminate.

    You dont need to sign anything for the contract to be valid

    they have been sending bills that outline what you are being charged for - you pay this and continue to use the phone = you have accepted the contract.

    Very true. I did indeed to a contract that contained free MMS messages. Not a contract that charged me 20p for them.

    To be honest, I'm happy with my contract, it suits my needs, and I don't really want to change because my whole family is on o2, so I make use of the free o2 to o2 bolt on. But I object to them changing the terms I agreed to with a few days notice. Surely they must have to give you more notice than that?
