It came as a far greater shock, however, to see they have deleted my partner’s entire Clubcard balance of 9,000 points. This is theft, plain and simple. We acquired every last one of these points in accordance with the terms and conditions of the scheme.
This was effectively our Wedding Fund - we were collecting these points to spend on a holiday from the Virgin Weddings brochure in a year’s time.
They have also said that they have voided the codes on the vouchers they have already sent to us over the last year. These vouchers are worth £340 - i.e. £1360 off a holiday.
Therefore they have just robbed us of points worth £1720 off our wedding. My partner is devastated and has been crying all night. Right now I am shaking with anger and can not really think straight.
But I can tell you the criminals at Tesco have now got an all-out war on their hands. I have some big plans, but I can’t reveal too much as I know they definitely read this thread.
Well, first of all, I can understand where the mix up between them having to give you a reason and not having to give you a reason comes from. Correctly people state that you can be banned from private land without reason. For instance I can say who comes in my house etc...
However, it is not quite as simple as that. You see there is such laws as human rights etc which state that you must not in anyway be discriminated about.
There is also the data protection act that states that they can not spread information about a person if that person does not want the information spread about them so long as the person has not broken any law.
As they are keeping information on you, and making a decision based on that information that is effecting your day to day life, they have no choice but to give you a copy of the information for a small fee. As they are making a decision to ban you they should give a reason so you are able to ascertain if they have broken the human rights act.
Example...
Man walks into a shop, the shop owner freely serves all the other customers until that person is at the front of the queue. The person then gets told they they are not allowed in the store. The person has a right to ask why so they can ascertain if they are being discriminated against.
Just to clarify the relevent sections of the data protection act...
Section 1(1)
"data" means information which ( c ) is recorded as part of a relevant filing system or with the intention that it should be part of that system.
(ie in this case a banned list)
Section 7 says that an individual should be given...
personal data to which the individual is the data subject,
the purpose for which that data is being processed,
the recipients or classes of recipients to whom the data has been or may be disclosed,
any information available to the data controller as to the sources of that information (Ed this would include any information gathered from online activities)
to be informed by the data controller as to the logic involved in the decision-taking when an automatic means of evaluating the individual. (Ed- ie has been flagged by a computer)
The data controller is obliged to supply any information when he has recieved a request in writting and a small fee not exceeding the maximum. He is satisfied that the person asking for the information is the person in the data. If the data controller rufuses on the grounds that the data contains information on others the individual may ask that only information about the individual is required (Ed- No get out clause for them based on others being on the list)
The data controller has to abide by a date which has been set and a start date is given.
(Once you have ascertained that the information that applies to yourself is not to your liking, and there is nothing in it regarding any laws to crimes you have commited within the store)
Section 10 says, that the data controller is required to get rid of any information they have on you on the grounds that, at the end of a reasonable period (it says 21 days) the proccessing of data which is likely to cause you or another substantial distress or damage when that distress or damage is unwarranted .
Section 13 says, an individual who suffers distress because the data controller has failed to comply with the requirments of the act, is entitled to compensation from the data controller.
Section 15 says, The jurisdiction conferred by sections 7 to 14 is exercisable by the High Court or a county court or, in Scotland, by the Court of Session or the sheriff.
I will do the Human Rights bit after I have had a cup of tea. But I think you can see that you have the right to be told why you are banned, what informatin they have on you regarding the ban and the right to remove that ban if you feel the information is based on the data (ie, you ask for the data to be removed then any decision based on that data must also be removed unless it is an illegal act etc), and sue for compensation if it is not removed.
Good eh?
Obviously goes without saying that they have to justify the reason for removing points and it would be correct to ask for compensation if the points were removed for a reason that is neither illegal or was based on bad data.0 -

I have mulled overnight about this and I guess that we cannot get Taxiphil's missus's points back.
However, I have a cunning plan.
If we all were to go to Tesco and buy everything that we can find on R&R and use a new temporary clubcard we could post the cards to Taxiphil so that he can register them and merge them one at a time.
Eventually he will get a big chunk back.
Opinions please.

Right after reading Phils plight and all the other members on this thread that have been treated badly and been made to feel embarressed and humiliated etc it is now time to take a stand against tescos.
I think we should all stop R&ring now.If you see a mis-price etc and you want the product (mainly the meat,books etc) buy them,take a picture of the sel/offer overprice etc,pay for the them and send a copy of the picture and a copy of your reciept to trading standards.If the info was true about how much tescos would be fined for each incident that this happens (Which is why i believe they have the R&R in place)we will see how much MrT's starts to lose in fines.They have had plenty of time to get their house in order and if £750k in R&R's doesn't wake them up (ie they are still putting posters up with the offers on etc) then maybe a few ££££,s in fines will wake them up.......©..®..(TM) NothingVentured.

Taxiphil, sorry to hear about your ban. I can understand why they have done it, however. As for the clubcard points, I can understand that too. I assume you used your girlfriend's clubcard on all your purchase, hence them cancelling her card. If you are banned from all Tesco stores, then there is no point you having a clubcard, as you cannot enter a store to use it. Tesco has the right to cancel a CC at any time, as it remains their property at all times. If they cancel your clubcard, it cancels out all the points and vouchers associated with that card. That's why all your points have gone, as well as your vouchers being invalidated.
Are you getting a letter detailing the ban? Does the ban include Tesco petrol stations and .com? Personally, I think it would be impossible to enforce the ban, as they probably don't have a photo of you and we know how good communication is between the stores and HO. Is your partner banned too?
Phil's been quite vocal with his complaints and R&Rs. He's drawn attention to himself a lot over the last month, including complaining to HO about a possible breach of the DPA by a manager. According to Phil, 50% of his refunds have had to go through HO, which means a total of around £1500-£2000 worth authorised by HO in one month. One other thing that Phil has done was to post pics of the POS for the console offers. He didn't use imageshack, which meant he made it easy for Tesco to track him down through the site he hosted those pics on. That way, Tesco would have been able to link his posts on this site to an actual name and address. Phil did nothing wrong and he never gave false information to Tesco. However, due to his high profile and the amount of money Tesco has lost as a result of his actions (and his actions were not wrong), Tesco has made an example of him. He stood up to Tesco, and rightfully so, but Tesco has answered back with a blanket ban and cancellation of the clubcard and all associated points. The ball is now in Phil's court as to what he wants to do from here.In a rut? Can't get out? Don't know why?

Regarding keeping below the radar net by using cash and NOt giving them your clubcard - what do you think about using a debit card from another bank ?
I've certainly stopped using my clubcard and tesco visa but I sometimes use switch for bigger 'shops' .I suppose they could in theory trace me from that but I'm not sure that would be legal.ELITE 5:2
