    I thought that a legally binding contract was made when the auction ended and the buyer paid.Both parties freely entered into the contract and the contract would be upheld even though the seller believed he had made a mistake with his listing.
    Does any one know if ebay sales/contracts have been subject to UK court decisions.
    This seems to be important with a number of sellers not honouring agreements.

    Someone, either here or on a similar site, related a case where he got sued by a solicitor when he mistakenly sold something he'd already sold. It wasn't at a crown court so no precedent was set.

    Personally I've always thought the whole "binding contract" thing was a load of old hooey. When I first tried to use ebay, I was the highest bidder on an item and the listing just vanished.

    When I moaned about it I was told that sellers could quite legitimately do that I should quit complaining. The same people who said this woul spout the "binding contract" line in other circumstances, thus showing their complete ignorance of the importance of consideration in English contract law.

    I suspect that if a case was brought and it went to appeal, it would eventrually be held that there was no contract since even if they follow the rules, there is no consideration on the part of the seller until the auction finishes. And if there is no consideration when the buyer makes their bid, how on earth can there be a contract?

  • Have just read this thread in disbelief.

    The seller is selling something that's not even new, so it's value is only what people are prepared to pay, not £20. It's not like a new item which has a list price. Also, at the end of the day, the difference between what it sold for and what he wanted for it is £9.50!!!! How petty can you be? Selling it at the final auction price is hardly going to put him on the breadline. :rolleyes:

    Having had dealings with a similar seller (although the item is totally unrelated to this one), it is clear to me that he is playing a game with his buyers, knowing that some people will do anything to avoid getting a negative feedback.

    We've all sold items that haven't made as much as we would have like, but at the same time, how many of us have bought things a lot cheaper than we expected?

    I would only have felt sorry (maybe) for the seller if he was selling an item which he thought he'd put a reserve of £200 on it but accidentally typed £20, and then it sold for £10.

    Even though he's only got a couple of negs, I know that I would never buy anything off him. Using the type of language he does in his replies just sums up the type of person he is and would put me off right away.

Well done, myself and my family of guitar players know not to touch you with barge pole! On my blocked list you go.

    We've all sold an item that didn't get the price we'd hoped, but we stick a smile on our faces and send the item in good faith and leave good feedback for the buyer who has after all done nothing wrong! After we've done this, we soon learn a swift lesson in listing items at a price we would accept and pay the fees that we receive a service for. It's called being a grown up, Krissy boy.

    OP how unfortunate to get a dreadful seller like this. I would file a NPS and neg him, without doubt.

    where if you expand the links it says :

    The feedback comment contains profane, vulgar, obscene, or racist language or adult material. Inflammatory language, such as "fraud, liar, cheater, scam artist, con man" etc, while discouraged, will not be removed.

    Which implies that the 'vulgar' feedback will be removed, but says nothing about feedback left *for* the user.
